All urban construction (new build, installation, extension, change of use, repair, rebuild, demolition) needs a permit first; you may start only after it is granted, and building without a permit is prohibited (2019 Ministerial Decision Art. 2; Construction Law Art. 24; Building Control Regulation Art. 66). Permits come in four types (new build/installation, extension/change of use, repair/rebuild, demolition/maintenance) and three levels by scale and impact: Level 1 (high-impact large buildings, controlled buildings, repair/rebuild) approved by the provincial/capital administration through a construction meeting; Level 2 (medium buildings, extension/change of use, demolition of large buildings) by the Provincial/Capital Public Works & Transport Department; Level 3 (small buildings) by the district/municipal administration (2019 Decision Arts. 5, 6, 11). Controlled buildings (classed by area, height or use risk, including public-use, flammable/explosive dangerous buildings): survey and design must be done by a legally established design firm and by registered architects and civil engineers; before applying for the permit, the design must first be certified for correctness by the building-control authority (Building Control Regulation Arts. 5, 6, 7, 9, 59, 60; Architects and Engineers Decision Arts. 5-7). Small residential construction (total floor area under 120 m²) may use approved existing drawings or a standard-type drawing, but still needs a permit (2019 Decision Art. 9).
