At a glance

Where to apply: Land and housing are not the same office and this is where people most often go wrong. Changes and dealings in land-use rights go to the district natural resources and environment office where the land lies (renamed agriculture and environment in some places from 2026 — the same door); state land leases and concessions, and buying a time-limited state allocation, go to the provincial department, and government-approved cases to the ministry’s land department; first issuance goes through the district one-stop unit. Housing registration is not a land-office matter — it goes to the public works and transport sector through the sub-district administrative committee. Contracts must also pass the village administration and then the court registry, which certifies their content, before the district office continues.

Steps:

  1. First separate land from housing — two routes, two sectors, different papers. The housing route also needs copies of the construction permit and the building compliance certificate, both obtainable only from public works and transport
  2. On the land route the holder or an authorised representative files the application and the papers for the particular case on the prescribed form at the district natural resources and environment office, which verifies the land title, issues a certificate of its authenticity and charges the service fee
  3. The district office hands the papers back for you to take to the court registry, which certifies the contract’s content in law, and the certified file returns to the district office

How long: The land route has detailed periods by matter (2023 land registration and change guidance): verifying the title takes one working day for a change registration and five for a dealing registration; the new title issues within four working days of the signed face-to-face memorandum; splitting and merging take fifteen working days; sales with repurchase conditions, easements, adding or withdrawing a mortgage and dealings in time-limited state allocations take three each; cancellations take two; copying a land file takes up to three working days, or five and free of charge for a state body; and remaking a damaged file takes five, free of fees for the holder. On the housing route the site data gathering is within thirty days and the certificate within five working days. One deadline people miss: income from a sale or transfer must be declared to the tax office where you live within fifteen days of receiving it.

Reliable fees: a state land title is 100,000 kip; a transfer of land-use rights that is neither between relatives nor an inheritance is banded by land value at 100,000, 200,000, 300,000 and 500,000 kip; collateral-relative inheritance or transfer at 30,000, 60,000, 120,000 and 150,000. Fixed items include an easement at 50,000, transfer of state land-use rights to an individual at 100,000 per title, transfer of a concession contract at 600,000, mortgaging or leasing a state allocation at 500,000, the same for an apartment at 300,000, and a land-business licence at 1,000,000. Unusable: the direct-heir band and the mortgage band, where our copy shows wildly different figures for the same band and two different thresholds — we give no number for those. A translation error worth knowing: the Chinese of Art. 25 renders the Lao ຕື້, a billion, as a trillion, so every threshold in the Chinese text is wrong; the bands above follow the Lao. Income tax is 2% on selling or transferring land-use rights, housing, buildings, or land with buildings, and 1% on agricultural land used for agricultural production, with exemptions for registered business assets already taxed on profit and for inheritance between grandparents, parents, spouses, children, siblings and grandchildren. Survey and form fees are unreadable in our copy, some provinces add their own 2% instruction which is not a national rule, and no housing-registration fee appears in the current decree.
