Setting up and operating a wood-processing factory: sawmills, processing plants and furniture factories in Laos: statutory documents, competent authority and legal basis

中文 · English · ລາວ

Who can apply

Both Lao citizens and foreigners may apply; the documents differ.

Competent authority: Wood-processing factories go through two stages and are split by size: small and medium factories are licensed by the provincial agriculture and environment department on forms HGM 02 and RM 05, while large ones are approved by the minister on form HGM 03 and licensed by the Forestry Department on form RM 06 (Arts. 28 and 34). Site inspection follows the same split, led by the province or the Forestry Department together with district offices, public works and transport, the sub-district and the village (Art. 27), and enterprise registration with industry and commerce comes first (Art. 22)

At a glance

Where to apply: Stage one: register the enterprise with industry and commerce, then file form RM 01 and eight copies with the agriculture and environment sector (Arts. 22 and 25); incomplete files come back within five working days (Art. 26); site inspection is led by the province for small and medium factories and by the Forestry Department for large ones (Art. 27); the establishment decision follows within ten working days of the signed record, on form HGM 02 or HGM 03 (Art. 28). Stage two: begin trial production within thirty days without selling, then file form RM 04 with eleven documents (Art. 30) for a licence issued within five working days on form RM 05 or RM 06 (Art. 34). Renewal is filed thirty days before expiry and includes a fresh site inspection (Art. 36).

Steps:

  1. Register the enterprise with the Industry and Commerce sector first (Art. 22) — without that certificate none of the rest can start
  2. File form RM 01 with eight copies to the Agriculture and Environment sector (Art. 25); if the file is incorrect or incomplete they must tell you in writing with reasons within five working days of receiving it (Art. 26)
  3. Once the site inspection is signed off, the sector issues the establishment decision within ten working days of that inspection record: small and medium factories by the provincial department head with the provincial governing committee chair’s agreement (form HGM 02), large ones by the minister on the Forestry Department’s proposal (form HGM 03) (Arts. 27, 28)

How long: An incomplete file is returned in writing with reasons within five working days (Arts. 26, 32). The establishment decision issues within ten working days of the signed site-inspection record (Art. 28). Trial production must start within thirty days of that decision, with no distribution or sale during the trial (Art. 28). The operating certificate issues within five working days of the committee’s signed assessment (Art. 34). Renewal must be requested thirty days before expiry, and if two years pass without a renewal request the certificate is suspended or withdrawn (Art. 36).

Cost: Art. 40 only says fees are charged under the regulations for issuing, renewing, amending and replacing the certificate, without an amount, and we found no line item for wood-processing factories in the 2021 fees decree either — so no figure is given here; go by what the counter posts. Note that the timber-source layer has its own fees under the tracking decision.

Are there time limits or hard requirements for a Setting up and operating a wood-processing factory: sawmills, processing plants and furniture factories in Laos?

Two stages, not one: the establishment permit on form RM 01 after enterprise registration (Arts. 22 and 25), then the operating licence on form RM 04 after trial production (Art. 30) — the establishment decision alone does not allow you to sell. Trial production must start within thirty days of the establishment decision, and selling or distributing during the trial is forbidden (Art. 28). Size decides the level (Arts. 9, 28 and 34): small and medium factories are licensed by the provincial agriculture and environment department on forms HGM 02 and RM 05, large ones by the ministry and the Forestry Department on HGM 03 and RM 06, and site inspection follows the same split (Art. 27). An incomplete file is returned in writing within five working days (Arts. 26 and 32); the establishment decision comes within ten working days of the signed inspection record (Art. 28) and the operating licence within five working days of the inspection (Art. 34). The factory must meet a full set of standards checked at inspection (Arts. 10 to 21): siting, buildings, machinery (new, or used under conditions), process, raw materials with certified legal timber origin, products, management, qualified staff, safety, hygiene and environment. Timber origin must be lawful and certified (Art. 15), with the day-to-day tracking of timber in and out of the factory governed by the separate decision of 16 January 2023. Five grounds for suspension (Art. 37), always with a fixed period to put things right, after which the industry and commerce sector is notified. Art. 40 defers fees to regulation without stating amounts and we found no wood-processing entry in the 2021 ordinance, so confirm at the counter. The governing text is the decision of 11 June 2026; the 2021 agreement and the 2023 decision are superseded and their document lists and article numbers differ, so filing from them leaves you short. Two numbers matter for renewal (Art. 36): file thirty days before expiry, and two years past expiry without applying costs you the licence; each renewal involves a fresh site inspection before reissue on forms RM 08 and RM 09. Expansion, relocation and transfer each need separate approval under Arts. 41 to 45, which do not itemise the documents, so follow the counter list.

How much does a Setting up and operating a wood-processing factory: sawmills, processing plants and furniture factories cost in Laos and how long does it take?

Cost: Art. 40 only says fees are charged under the regulations for issuing, renewing, amending and replacing the certificate, without an amount, and we found no line item for wood-processing factories in the 2021 fees decree either — so no figure is given here; go by what the counter posts. Note that the timber-source layer has its own fees under the tracking decision.. 36)..
