Statutory requirements
- A preferential Certificate of Origin proves goods originate in or were processed in Laos so they can obtain trade preferences (tariff cuts) in the destination country under that country's origin rules — it is a customs-preference document, not a geographical indication. If the importing country granting the preference does not require an origin certificate, no application is needed (Guideline Art. 1).
- The traditional route has two steps: first apply for the Confirmation of Product Originality (COS), then use it to apply for the preferential Certificate of Origin (CO) for each export consignment. The CO is issued in three forms: (1) manual issuance by the authority; (2) the e-CO electronic system (Agreement on e-CO, the 2016 electronic certificate of origin agreement); (3) self-certification by a registered exporter (see next). (Guideline Arts. 1, 2, 6)
- Self-certification: a registered exporter issues its own Statement on Origin for each export to claim tariff relief in the destination country, replacing the Form A certificate — no need to collect a certificate each time; but eligibility must be obtained first — Pre-Registration via the EU website, enrolment in the Registered Exporter System (REX), and filing an application, the Pre-Registration and an existing CO with the Import-Export Department, which issues the exporter certificate within 2 working days. Records must be kept at least 3 years (the 2020 self-certification decision, Arts. 3, 5, 7, 8, 10, 12).
- Confirmation of origin (COS): after documents are complete and checked, the officer inspects the factory/premises immediately and within 3 working days at most; the confirmation is issued within 3 working days after that inspection. It is issued per product by 6-digit HS subheading, is valid for one year, and may be renewed within one month before expiry (Guideline Arts. 4, 5).
- Preferential CO (manual): attach the application, a copy of the COS or origin proof, the completed certificate, and the export invoice and packing list (for retroactive issuance also the customs declaration and shipping documents). The certificate is filled in English capitals, clearly, with no alterations, and unused blanks struck through; the authority issues it within 2 working days of complete documents (Guideline Arts. 7, 8, 9).
- Loss or damage: present a copy for certification (1 working day), or attach a loss/damage letter to apply for reissue (2 working days). Correction: if caused by the officer, the officer signs and stamps at the correction and no fee is charged; if caused by the applicant, attach the original and a copy to apply for reissue (Guideline Arts. 11, 12).
- Exporter's duties: submit the customs declaration detail and shipping documents to the authority within 5 working days of export; keep copies of the CO and related documents at least 3 years for destination-country verification or later tracing (Guideline Art. 16).
