Articles

Article 1

Purpose. This Decree stipulates principles, regulations, and measures for the management, monitoring, and inspection of work related to catchment areas and reservoirs, to ensure the protection and utilization of water resources, following a sustainable and green direction, aiming to create a balance in the ecosystem, while contributing to the socio-economic development of the country in various periods.

Article 2

Management of Catchment Areas and Reservoirs. Catchment area management refers to the organization and implementation of work concerning the survey, registration and account establishment, preparation of management plans, assessment and delineation of water and water resource protection zones, determination of water flow, water allocation, and water quality management. Reservoir management refers to the organization and implementation of work concerning the survey, registration and account establishment, preparation of plans for reservoir water storage management and scheduling in various activities, and water quality management.

Article 3

Interpretation of terms. The terms used in this Decree shall have the following meanings: 1. Catchment area means the entire land area, water surface area, and forest area from the source to the estuary, with watersheds where rainfall converges to form a water source system, such as the Mekong River (Nam Kong River), Nam Ou River, Nam Ngum River, Nam Hin-Nam Kadin River, Se Bang Fai River, Se Kong River, etc.; 2. Reservoir means a system for storing water by digging ponds or damming streams and rivers, to maintain sufficient and reserved water volume, aiming to ensure needs in domestic use, agricultural production, and stability of the natural and social environment; 3. Physical characteristics of a catchment area means the location conditions, area, length, water flow gradient, precipitation, and water flow rate in the river channel of the catchment area; 4. Warning point means a location in a river channel or reservoir where the water level rises or falls beyond normal levels, requiring monitoring of water inflow into the river channel and adjacent reservoirs to prevent and respond to potential disasters; 5. Danger point means a location in a river channel or reservoir where the water level rises or falls beyond the warning point level, requiring response measures to mitigate potential disasters; 6. Reservoir emergency means a sudden event occurring in a reservoir due to human or natural causes, such as the water level in the reservoir rising or falling to a danger point, erosion or collapse of dams or weirs, cracks or ruptures in pipeline systems or water conveyance canals, thereby causing disasters and damage to human and animal life, health, property, and the environment; 7. Model means the use of technical tools to study and assess water and water resources, simulate events existing in the current state of the catchment area, and predict possible future situations.
