To elaborate on the implementation of Decree No. 472/PM, dated December 30, 2019, on Infant Food Products and Related Feeding Utensils, ensuring its content is detailed and appropriate for each stage, and to guarantee unified, efficient, and effective organization of implementation, the Minister issues the following Guidance:

Article 2

General Provisions. 1. Purpose: This guideline provides guidance to individuals, legal entities, and organizations, especially health personnel working in the healthcare system, as well as operators engaged in the business of infant food products and related feeding utensils, to inform and enable them to understand how to implement the Decree on Infant Food Products and Related Feeding Utensils, No. 472/PM, dated December 30, 2019, aiming to ensure the physical health of infants and contribute to the defense and development of the nation. 2. Definition of Terms: 1) Codex Alimentarius—refers to the standards, guidelines, and codes of practice adopted by the Codex Alimentarius Commission, as well as food standards established by the World Health Organization and the Food and Agriculture Organization of the United Nations, aimed at protecting consumer health and ensuring fair practices in food trade; 2) Community—refers to places where numerous individuals gather together in residential, public, and private premises, such as commercial centers, markets, retail stores, airports, bus or passenger stations, parking lots, factories or companies, educational institutions, nurseries, kindergartens, children's playgrounds; 3) Consumer—refers to an individual, legal entity, or organization that lawfully purchases or uses goods and services without commercial purposes; 4) Infant Food Products—refers to products used for infants from birth to thirty-six months of age, either in conjunction with or as a substitute for breast milk, such as infant formula, follow-on formula, or growing-up formula; 5) Artificial Nipple (Teat)—refers to rubber nipples, glass nipples, or various types of nipples used for feeding infants, other than the mother's nipple; 6) Bundled Product Promotion—refers to a marketing form where operators combine other products with infant food products and utensils to attract consumers; making the packaging, brand, and labeling of infant food products and utensils resemble other products or approximate other brands; and conducting promotional activities for a product in conjunction with infant food products and utensils; 7) Healthcare System—refers to a network of health services for mothers, pregnant women, and infants, involving directly or indirectly state agencies, non-governmental organizations, legal entities, organizations, or individuals; 8) Marketing—refers to any form or method of directly or indirectly sponsoring, advertising, and disseminating information about infant food products and utensils for sale or distribution, including bundled products and online marketing. 3. Scope of Application: This guideline applies to individuals, legal entities, and organizations that directly or indirectly engage in and are involved in activities related to the Decree on Infant Food Products and Related Feeding Utensils within the Lao People's Democratic Republic.
