Article 1
Purpose. This Agreement stipulates the principles, regulations, and measures concerning the management, supervision, and inspection work of the Vientiane Capital to Vang Vieng Concession Expressway, in order to ensure the use and passage of the expressway is convenient, smooth, safe, orderly, and standardized, aiming to reduce traffic accidents, protect the lives and property of individuals, legal entities, the Concessionaire, and the public, enable connection with the road network, and contribute to the national socio-economic development.
Article 2
Management of the Vientiane-Vang Vieng Concession Expressway. The management of the Vientiane-Vang Vieng Concession Expressway refers to the work carried out during various periods on this expressway, including facilitation, control, supervision and inspection, construction, maintenance and repair, installation of safety components and safety protection facilities, usage, and maintaining its orderly and safe condition.
Article 3
Definition of Terms. The terms used in this Agreement shall have the following meanings: 1. "Expressway" means a road on which motor vehicles can travel at high speed throughout the entire section, being a closed road with no at-grade intersections or forks between toll stations, with divided lanes, separate travel directions for two-way traffic, controlled vehicle access with designated entry and exit points, and toll collection at terminal stations; 2. "Concession" means the state permits the concessionaire to invest in and develop the expressway through a Build-Operate-Transfer (BOT) method, and to execute it in accordance with the conditions and term specified in the concession contract; 3. "Concessionaire" means the Laos-China Joint Venture Expressway Development Co., Ltd.; 4. "Rest Area" means a temporary rest facility established along the expressway, used to provide rest for drivers and travelers and convenience for inspecting their vehicles during the journey; 5. "Tunnel" means a vehicle passageway excavated through a mountain, with portals at both ends, and fully equipped with systems for power supply, water supply, telecommunications and communication, drainage, and safety protection; 6. "Overpass" means a bridge constructed to cross over the expressway, serving as a pedestrian or vehicle passageway, ensuring the safety of people and vehicles; 7. "Underpass" means an underground road passing beneath the expressway, connecting the rest area buildings with other locations on both sides of the expressway; 8. "Expressway Enforcement Officer" means a person appointed or assigned by the Ministry of Public Works and Transport and the Ministry of Public Security, responsible for carrying out supervision and inspection duties related to expressway operations.
