Article 1
Purpose. This Agreement stipulates the principles, regulations and measures regarding the management, inspection, and testing of prepackaged goods produced, imported, exported, and sold in the Lao People’s Democratic Republic, to comply with the regulations stipulated by the Lao People’s Democratic Republic and internationally, in order to facilitate trade, aiming for social justice and safety, ensuring uniformity in implementation nationwide, and aligning with the principles of prepackaged goods inspection of ASEAN countries and internationally, to manage prepackaged goods concerning the characteristics, specifications, weight, content, and volume indicated on their labels.
Article 2
Management of Prepackaged Goods. Management of prepackaged goods refers to the tracking, inspection, testing, and certification of prepackaged goods (regardless of whether they have obtained prepackaged goods label certification) that are contained in a certain container or packaging, with their characteristics marked and the quantity of goods indicated, prior to sale. The quantity of prepackaged goods shall not be altered without opening or modifying the packaging.
Article 3
Interpretation of Terms. The terms used in this Agreement have the following meanings: 1. "Prepackaged product" means a product commodity contained in a packaging container; 2. "Marking symbol" means the prepackaged product label of the Lao People's Democratic Republic; 3. "Nominal quantity (Qn)" means the quantity indicated on the prepackaged product label in units of measurement, such as size, volume, weight, number of pieces, or content; 4. "Actual quantity (Qr)" means the quantity obtained through on-site inspection; 5. "Prepackaged product lot" means prepackaged products contained in packages of the same size, name, or commercial mark, produced during the same period; 6. "Production batch (N)" means the prepackaged products within a lot used to provide baseline data for inspection; 7. "Sample size (n)" means the prepackaged products drawn from the production batch for inspection; 8. "Sampling" means the selection of prepackaged products according to the method specified in Table 05 of Annex (1) to this Agreement; 9. "Tolerable error (T)" means the acceptable deviation between the nominal quantity and the actual quantity of a prepackaged product; 10. "Non-compliant package" means a package that does not comply with the regulations specified in this Agreement; 11. "Label" means an item written, printed, or presented as an image, affixed, attached, embossed, stamped, or accompanying the package containing a prepackaged product, used to promote the brand, indicate, or provide information about the prepackaged product or the contents within the package; 12. "Packaging material" means the packaging container or the container holding the packaging; 13. "Acceptable number of non-compliant samples" means the number of prepackaged product samples that, upon inspection, have an error below or exceeding the acceptable range but have not yet exceeded the maximum allowable range; 14. "Overall batch average" means the average of the actual quantities of prepackaged products taken from the submitted products; 15. "Staff" means personnel responsible for the inspection of prepackaged products; 16. "Operator" means a producer, importer, exporter, seller, or service provider of prepackaged products.
