Article 1
Preamble. This guideline is issued pursuant to: the Law on State Investment (Amended) No. 72/NA, dated December 15, 2015; the Law on State Budget (Amended) No. 71/NA, dated December 16, 2015; the Decree on the Management and Use of Official Development Assistance No. 357/GoV, dated October 9, 2019; and the Decree on the Organization and Operation of the Ministry of Planning and Investment No. 201/PM, dated June 30, 2017. The Deputy Prime Minister and Minister of Planning and Investment hereby issues the following guideline.
Article 2
I. Purpose. This Guiding Opinion aims to implement and guide the implementation of certain provisions of the Law on State Investment No. 72/2015/QH13, dated December 15, 2015, Decree No. 357/2019/ND-CP, dated October 9, 2019, on the Management and Use of Official Development Assistance (ODA) Funds, and other subordinate legislation on the management and use of counterpart funds, to allocate counterpart funds for the implementation of ODA projects. It aims to enable ministries, ministerial-level state agencies, local administrative agencies, and relevant departments responsible for managing and implementing ODA projects at all levels to determine ODA programs or projects, particularly those implemented with funds from non-refundable aid, concessional loans, technical non-refundable aid, etc. (from development partners, excluding aid from the Government of the People's Republic of China and the Socialist Republic of Vietnam).
