Article 1
Purpose. This Agreement stipulates the principles, regulations, and measures concerning the determination of compensation unit prices, used to compensate for property losses to those affected by the Urban Flood Risk Management Project in Xay District, Oudomxay Province, aiming to provide reasonable compensation for losses, in accordance with the Prime Minister of the Lao People's Democratic Republic's Decree No. 84/Government, dated April 5, 2016, on Compensation for Losses and Resettlement for Development Projects.
Article 2
Compensation for Losses. Compensation for losses refers to the compensation provided for land, buildings, crops, and income affected by the Xaysettha District Urban Flood Risk Management Project, calculated based on the converted value, which may be converted into land, in-kind goods, or cash.
Article 3
Term Interpretation. The terms used in this agreement are defined as follows: 1. Flood Risk Management Project: refers to a state-invested project, with defined activities, types, areas, scope of bearing, and conditions for mitigating flood impacts, as well as the implementation steps, methods, budget, and timeline; 2. Affected Persons: refers to individuals or legal persons directly or indirectly affected by the project development, registered based on information collected through field surveys, or registered on the date of registration of affected persons' rights; 3. Resettlement and Relocation: refers to the relocation of affected persons' buildings and residences out of the construction area of the Xai County Town Flood Risk Management Project to new residences; 4. Property Type: refers to land, buildings, crops, and others, determined based on the actual use of the plot; 5. Compensation Unit Price: refers to the unit cash amount approved to compensate affected persons due to the construction of various activities of the Xai County Town Flood Risk Management Project; 6. Social Stratum: refers to ethnic groups or individuals, legal persons, groups, and any organization within society that benefit from and are affected by the project; 7. Marking: refers to codes represented by letters and numbers, determined according to the table, as follows: A, B, C, D, indicating property types; A1..., B1..., C1..., D1... indicating property subtypes.
