Article 1
Subject: Order on Strengthening Attention to the Inspection of Labels of Fertilizers, Pesticides, and Seeds. To: Director General of the Department of Agriculture; Directors of the Agriculture and Forestry Offices of Provinces and Vientiane Capital. Pursuant to: The Agriculture Law, No. 01/98 NA, dated October 10, 1998; The Decree on the Organization and Activities of the Ministry of Agriculture and Forestry, No. 99/PM, dated March 9, 2017; The Proposal Letter of the Department of Agriculture, No. 1976/DA, dated September 10, 2020; The Study and Proposal of the Department of Policy and Legislation, No. 0712/DPL, dated September 21, 2020. In the past period, the agriculture and forestry sector has detailed laws and decrees into subordinate legislation and various technical manuals, and has disseminated and publicized them to society and implemented them well, particularly the affixing of labels on containers of fertilizers, pesticides, and seeds; however, despite this, through on-site inspections by pesticide inspectors, non-compliant labels were still found, such as labels not in the Lao language, lacking information or instructions for use, leading to the risk of using production materials of poor quality, deteriorated, and causing serious harm to humans, animals, plants, and the environment. To address the above negative phenomena and to ensure that users of fertilizers, pesticides, and seeds receive correct information regarding types, usage techniques, and safe storage, the Minister of Agriculture and Forestry hereby issues the following order:
Article 2
Provincial and capital agriculture and forestry departments are designated as the competent authorities to inspect and guide business operators dealing in fertilizers, pesticides, and seeds to affix labels in accordance with regulations as follows: 1.1 Products produced or imported for sale must have labels in the Lao language; if the operator wishes to retain foreign language content, bilingual labels in both Lao and a foreign language may be produced, subject to approval by the Department of Agriculture, and must meet the following conditions: - The Lao language content of the label must be consistent with the foreign language label content; - The printing on the container must be clear and legible; - The label size must cover three-quarters of the container's surface area; - For packaging containers such as bags or sacks, printing must be on both sides; if the packaging container is a bottle or glass container, it must be printed on adhesive stickers and affixed; if printing on bottles or bag containers is not possible, a label must accompany the packaging container. 1.2 For imports intended for research and experimentation, assistance in pest and disease control, and serving businesses benefiting from investment promotion policies, labeling as per point 1.1 of this Order is exempted, but information on the importer's name, address, and telephone number must be affixed to the container, along with the words "Not for Sale" printed, and the registration number of the fertilizer, pesticide, or seed must be clearly visible and legible.
