Article 1
Purpose. This Decision stipulates the principles, regulations, and measures concerning the management of agricultural investment under the 1+2+3 model, in order to ensure that such investment is correct and complies with laws and regulations, with a view to developing land, ensuring clean agricultural production, and contributing to the socio-economic development of Bolikhamxay Province.
Article 2
Management of agricultural investment under the 1+2+3 model. Management of agricultural investment under the 1+2+3 model refers to the state's management of agricultural production carried out by the people and investors using the people's land in accordance with the law, with the people participating in labor, while the investor is responsible for: (1) capital, (2) technology, (3) market, and is based on ensuring the interests of the state, the people, and the investor.
Article 3
Interpretation of Terms. The terms used in this Decision have the following meanings: 1. Agriculture: refers to cultivation, animal husbandry, and fisheries, to meet societal needs for food and food products, as raw materials for processing industries, and as commodities for domestic supply and export; 2. The 1+2+3 model means: (1) State management, where the State is the approver, supporter, facilitator, monitor, and resolver of disputes in investment; (2) People's participation, where the people contribute: first, legal land; second, labor participation according to the production process; (3) Direct investment by the investor, namely: first, capital; second, technology; third, the market; 3. Investor: refers to domestic and foreign individuals and legal entities registered to operate legally in the Lao People's Democratic Republic; 4. Capital: refers to funds invested by the investor in agricultural production projects; 5. Land use right: refers to the right to use land held by an individual or organization based on a land title deed, which is a certificate of land use rights derived from grants, exchanges, purchases, and inheritance. The individual or organization holding this land use right has the right to lease, mortgage, contribute as joint venture capital, exchange, or sell this right, subject to compliance with laws and regulations; 6. Technology: refers to the control over the production process of that crop, from seed selection, land, planting, field management, harvesting, and processing, to meet established standards; 7. Market: refers to the place where the investor sells products domestically and abroad; 8. Standard: refers to specific specifications determined for products, goods, services, the environment, and production processes related to product quality; 9. Clean agricultural production: refers to Good Agricultural Practices (GAP) systems and organic agricultural production, where Good Agricultural Practices require methods to prevent or reduce risks of potential hazards during production, harvesting, and post-harvest processes; organic agricultural production effectively does not use chemical fertilizers or chemical pesticides; 10. Chemicals: refers to fertilizers, pesticides, herbicides, hormones, coating agents, and soil nutrients; 11. Pesticides: refers to products used to control pests, insecticides, fungicides, botanical pesticides, and fumigants; 12. Contamination: refers to the contamination of workers, water sources, soil, products, equipment, tools, and clothing with chemicals or harmful microorganisms; 13. Short-life cycle crops (annual crops): refers to crops with a short life cycle that can be harvested in one cycle; 14. Fruit trees: refers to crops with a lifespan exceeding one year that can be harvested continuously for several years; 15. Environment: refers to all living and non-living things within a certain boundary, whether naturally occurring or man-made, such as humans, animals, plants, and other things that interact and have positive or negative impacts on the survival, stability, and development of humans and nature.
