Articles
Article 1
Purpose. This Decision aims to prescribe the principles, regulations, and measures regarding the collection of forestry resource fees, reforestation obligation fees, and non-timber forest product management fees, so as to ensure that the collection of the aforesaid fees is efficient, uniform, transparent, and fair, to safeguard national fiscal revenue, and to promote the economic and social development of this Province.
Article 2
Collection of Forestry Resource Fees, Reforestation Obligation Fees, and Non-Timber Forest Product Management Fees. Forestry resource fees, reforestation obligation fees, and non-timber forest product management fees refer to the obligatory financial fees payable to the state by individuals, legal persons, and operators, whether domestic or foreign, who have obtained permits and generate income from the exploitation of non-timber forest product resources, at the rates stipulated in this Decision.
Article 3
Interpretation of Terms. The terms defined in this Decision have the following meanings: 1. Non-timber forest products (NTFPs): refers to various types of plants that primarily grow and reproduce naturally in forests; each type of NTFP may include stems, stalks, vines, tubers, roots, shoots, sprouts, leaves, flowers, fruits, seeds or kernels, bark, oil, resin, fungi, honey, medicinal plants, etc.; 2. NTFP resource fee: refers to the fiscal obligation fee that domestic and foreign individuals and legal entities engaged in the business of NTFPs with permission must pay, as stipulated in the President's Decree No. 001/ປປທ (December 15, 2015); the collected NTFP forestry resource fee must be remitted to the state budget as prescribed; 3. Reforestation fee and NTFP management fee: refers to the reforestation fee and management fee that domestic and foreign individuals, legal entities, and operators engaged in the business of NTFPs with permission must pay, at the rates stipulated in this Decision, the President's Decree No. 003/ປປທ (December 26, 2012), and the Prime Minister's Decree No. 38/ນຍ (February 21, 2005); 4. Forest areas with divided NTFPs: refers to forests and forest land divided to meet the socio-economic development needs of the province, enabling the utilization of NTFPs to be carried out systematically and sustainably; 5. Infrastructure development zones with NTFPs: refers to areas officially approved by the government for reclamation and construction of new roads, power plant construction areas, reservoir inundation areas, mineral extraction areas, etc., which encompass forest land and contain NTFPs, requiring their collection and utilization to maximize benefits for the state; 6. NTFP business: refers to activities of harvesting, purchasing, and processing NTFPs conducted by domestic and foreign individuals, legal entities, and operators with permission, and under the management, supervision, and inspection of relevant departments (such as the Department of Agriculture and Forestry, Department of Industry and Commerce, Department of Finance, Department of Health [for medicinal plants], and District Government); such business activities must pay resource fees, reforestation obligation fees, and NTFP management fees as stipulated in this Decision; 7. Household use of NTFPs: refers to the collection and utilization of NTFPs by the people according to customs, for daily life and the production of household handicrafts.
