Articles

Article 1

Registration of Production Sites. Provincial planting departments must, within three working days from the date of issuing the production site inspection certificate, submit the complete set of documents and the production site inspection certificate to the Planting Department for consideration and handling of production site registration. Upon receipt of the complete set of documents and the production site inspection certificate, the Planting Department must, within five working days, review and issue the production site registration certificate in accordance with the format specified in Annex 4 of these Guidelines. In cases of doubt, the Planting Department must conduct an on-site inspection and assessment of the production site before processing the production site registration. The production site registration number shall consist of the serial number, production farm code, provincial code, plant code, and tax registration number.

Article 2

Use of the Production Site Registration Certificate. The production site registration certificate for export applies to specific plants and plant products, is valid for three years, and may be renewed. The procedures and methods for renewing the production site registration certificate are stipulated in the guidelines of the Department of Agriculture. If production sites are added or reduced, or if new plant species are changed, an application for amendment of the production site registration certificate must be submitted through the provincial-level agriculture and forestry department in accordance with Article 2 of these guidelines. If the production site registration certificate is lost or damaged, the certificate holder must report to the relevant provincial-level agriculture and forestry department within fourteen days from the date of loss or damage, accompanied by a declaration of loss. Upon receipt of the above documents, the Department of Agriculture must reissue the production site registration certificate within three working days from the date of receiving complete and correct application documents.

Article 3

Suspension or revocation of the production site registration certificate (pursuant to Decision No. 2986/Plant Protection Department dated June 28, 2019, on phytosanitary measures for the export and re-export of plants, plant products, and controlled articles) shall occur in any of the following circumstances: 1. Upon request by the importing country; 2. Upon application by the holder of the production site registration certificate; 3. Upon serious violation of laws, regulations, and this guidance. Upon receipt of the suspension notice from the Plant Protection Department, the owner of the production site must review the reasons and seek solutions or undertake rectification to restore normalcy within the specified timeframe in accordance with technical principles. If the owner of the production site fails to rectify within the prescribed timeframe, the Plant Protection Department shall revoke the production site registration certificate in accordance with the law.
