Article 1
[Plastic Waste Processing Factory] A plastic waste processing factory refers to a factory that:
1.1 Belongs to one of the twenty-four categories of processing industry factories specified in Article 8 of the Processing Industry Law No. 48/NA, dated December 27, 2013, corresponding to Lao Economic Classification (ISIC) codes: Group 2221 "Manufacture of Plastic Products" and Group 3830 (or Subgroup 38302) "Recycling of Waste and Scrap";
1.2 Is a factory that inputs plastic waste materials into a processing process, using machinery and labor within the factory to transform them from their original state into semi-finished or finished plastic products, which may be sold as goods.
Article 2
[Operating Conditions for Plastic Waste Processing Factories] To operate a plastic waste processing factory, the following conditions must be met:
2.1 Possess licenses: 1) Enterprise registration certificate; 2) Investment license or business operation license; 3) Factory environmental verification certificate; 4) Construction permit; 5) Factory operation verification certificate.
2.2 Possess complete technical standards in all aspects as specified in Article 3 of this Guideline.
2.3 Have at least one specialized technical personnel (primarily in chemistry or environment).
2.4 Possess an economic-technical feasibility report for the factory, and have supporting funds for factory management, used for tracking and inspecting the factory's technical standards and environment (the Department of Industry and Handicraft will issue separate guidance documents regarding supporting funds).
Article 3
[Standards for Plastic Waste Processing Plants] Plastic waste processing plants shall meet the following technical standards in various aspects:
3.1 Plant site; 3.2 Buildings within the plant; 3.3 Factory production workshops; 3.4 Machinery used within the plant; 3.5 Production processes within the plant; 3.6 Storage of plastic waste raw materials; 3.7 Treatment and disposal of waste; 3.8 Factory safety; 3.9 Factory hygiene; 3.10 Factory management.
