Article 1
Purpose and Scope of Application. Agree to determine the regulations and principles for compensation for losses, land use rights, above-ground structures, crops, and other development activities within the reserved area expropriated for the Laos-China Railway project, covering the two districts of Nasaythong District and Xaythany District, Vientiane Capital. This aims to mobilize the people affected by the project to understand and endorse the government's policies and guidelines on infrastructure construction, sincerely participate in construction and development, and implement them correctly and effectively, ensuring that affected persons receive compensation for losses and resettlement relocation, so that their living standards are improved or maintained compared to the past, in order to smoothly advance the construction of the Laos-China Railway project in the two districts, enabling them to receive reasonable and practical compensation for losses, in accordance with the provisions of the Prime Minister's Decree No. 84/Government, dated April 5, 2016; and to serve as the basis for surveys, data collection, and the determination of unit prices for compensation for losses of affected persons.
Article 2
Principle of Compensation for Losses and Reserved Areas for Expropriation.
2.1 The principle for determining the method of calculating the unit compensation price for each district and each village, i.e., using actual transaction data from each area, combined with the land value assessment zones according to Agreement No. 352/ dated May 31, 2011 (currently used for land use rights registration transfer—transfer), taking the average value as the compensation price.
2.2 The reserved areas for the Laos-China Railway expropriation in Nasaythong District and Xaythany District shall be delineated as reserved areas of varying widths based on the terrain and actual project usage needs; some sections are for the route, some sections are for small stations or large stations. The aforementioned reserved areas shall be included in the compensation system and serve as permanent reserved areas for the project. For land remaining outside the railway reserved area, the project shall bear the cost of remediation and issue new land titles for the remaining portion to the affected persons; regardless of the amount remaining, it remains the land use right enjoyed by the affected persons in accordance with the law. The railway project establishes the principle of compensating affected persons for above-ground structures and crops, creating conditions for relocated persons to build alternative residences; structures are calculated only by volume, without accounting for depreciation, and trees are calculated by age; affected persons may relocate and demolish their structures and trees using the compensation received; demolition of structures and felling of trees for other uses must be completed within the timeframe specified by the project, failing which the project may use machinery to demolish and clear obstacles.
