Articles

Article 1

Purpose. This Law establishes principles, rules, and measures for the management, protection, research, cultivation, and utilization of plant varieties, aiming to cultivate new plant varieties, improve variety quality, and promote the use of superior and introduced varieties to serve production, processing, ensure food security, and commercial production, thereby contributing to the national socio-economic development.

Article 2

Types of Plant Varieties. Plant varieties referred to in this Decree-Law include improved varieties and introduced varieties. Improved varieties refer to varieties that have been selected and bred, possessing distinctiveness, uniformity, and stability that differentiate them from other varieties of the same species or genus.

Article 3

Definitions. The terms used in this Decree shall have the following meanings: 1. “Improved plant variety” means a plant variety that is productive within a certain period and region and has been bred through selection; 2. “Local plant variety” means a plant variety that naturally exists in a certain area and possesses its distinctive characteristics; 3. “Introduced plant variety” means a plant variety bred from a certain plant species, possessing its distinctive characteristics, and introduced from abroad; 4. “Seed” means plant propagation material used for reproduction or regeneration, including roots, stems, buds, leaves, seedlings, fruits, flowers, and seeds; 5. “Plant genetic resources” means materials derived from a certain plant variety that are valuable for breeding new varieties; 6. “Conservation of plant genetic resources” means the preservation of plant genetic resources to conserve a certain plant species under certain regional and natural conditions; 7. “Supplementary seed” means seeds existing in a wild or semi-wild state, providing genetic material for conservation and research; 8. “Seed quarantine” means measures for inspecting seeds to detect and prevent the spread of harmful organisms and diseases through seed circulation; 9. “Seed certification” means the procedure for verifying seed quality (distinctness, uniformity, stability, as well as purity, moisture content, and disease status).
