Summary

This Decision of the Ministry of Posts and Telecommunications prescribes principles for the management, monitoring and inspection of the protection of users of telecommunications and internet services, types of protection, protection against nuisance calls and spam messages, complaint channels and procedures, management bodies at all levels, rights and obligations of service providers and users, prohibited acts, and reward and penalty measures.

Articles

Article 1

Purpose. This Decision stipulates the principles, regulations, and measures for the management, monitoring, and inspection of activities related to user protection work, in order to ensure that telecommunications and internet services are of high quality, meet standards, are transparent, fair, convenient, and fast. It aims to safeguard the rights and interests of users, ensure social peace, and contribute to economic and social development.

Article 2

User Protection. Protection of telecommunications and Internet service users refers to the application of relevant measures to safeguard the property, legitimate rights, and interests of users affected by the use of services and/or the use of telecommunications and Internet products, such as unfair charging of telephone and Internet service fees, unfair deduction of data packages, and receipt of nuisance calls or text messages.

Article 3

Term Interpretation. The meanings of terms used in this Decision are as follows: 1. Service Provider refers to an entity providing telecommunications and Internet services; 2. User refers to an individual, legal entity, or organization using telecommunications and Internet services; 3. Service refers to services, provision for use, or provision of property benefits in exchange for monetary or other consideration; 4. Products refer to telephone and Internet numbers, fixed telephone systems, mobile telephone systems, Internet network systems, phone top-up cards, etc.; 5. Data Package refers to the data traffic sent and received via the Internet; 6. Unfair Deduction of Data Package refers to deductions made to data traffic sent and received via the Internet that do not correspond to actual usage (for monthly package service systems) or do not correspond to the actual package advertised or purchased by the user (for top-up package service systems).
