Article 1
Purpose: This Decision establishes principles and regulations regarding the compensation unit prices for property losses of people affected by the Houay Hua Hydropower Project (in Pakxanchalunsut District and Paksong District, Champasak Province). It aims to inform and ensure that people affected by the project understand the government's development policies and participate sincerely in construction and development, in order to guarantee that affected persons receive compensation for losses, resettlement-relocation, and improved living conditions, ensuring their lives are reasonably not lower than the original state or better, in accordance with the Decree on Compensation for Losses and Resettlement of People Caused by Development Projects, No. 84/LB, dated April 5, 2016.
Article 2
Compensation Unit Price for Property Loss: The compensation unit price for property loss refers to the price or value of land, buildings, trees, crops, and other property, initially priced according to specific regulations and calculated based on the value of such items in the current economic period, after agreement among the three parties—the Loss Compensation Responsibility Committee, the project owner, and the people affected by the project—serving as the compensation unit price for various types of affected property in the project. Loss compensation refers to compensation for land, buildings, crops, livestock, and income affected by development projects, through replacement value in the form of land, in-kind, or monetary compensation, i.e., determining conditions, forms, methods, and policies based on policies, the government's socio-economic development plan, and the circumstances of a particular development project, and determining and estimating the compensation value for each item of the project with the participation of the people.
Article 3
Interpretation of Terms: The terms used in this Decision shall have the following meanings: 1. Affected Person, refers to an individual or legal entity who directly or indirectly loses land or any property due to project development, divided into three categories: Category One, refers to individuals or families who lose their residence (house), residential land, various types of buildings, and production land (such as paddy fields, gardens); Category Two, refers to individuals or families who lose production land (such as paddy fields, gardens, upland rice fields, etc.) but do not lose their residence; Category Three, refers to individuals or families who lose their residence (house), while their production land (paddy fields, gardens, upland rice fields) is partially unaffected. 2. Property, refers to items owned by an individual or legal entity (buildings, land, crops, etc.); 3. Project Owner, refers to the investor (Lao National Power Company); 4. Land, refers to land used on a long-term basis, such as residential land, paddy fields, gardens, fishponds, and other land for which there are land title deeds, land possession declarations, cadastral maps, tax payment receipts, or certificates of use issued by village-level or other administrative authorities, serving as supporting evidence; 5. Cemetery Forest (ປ່າຊ້າ), refers to a specific area referred to by the various ethnic groups of Laos and used for conducting religious ceremonies when someone dies; 6. Sacred Forest/Protective Forest (ປ່າສັກສິດ/ປ່າມະເຫສັກ), refers to a type of forest area revered and worshipped by certain ethnic groups, who believe it is protected by sacred spirits.
