Articles

Article 1

Purpose. This Decision stipulates the principles, procedures, types, nature, general forms, steps, principles, and various processes in the research, formulation, and amendment of regulations; stipulates the work of publishing in the Government Gazette and regulatory impact assessment; and makes provisions for the regulatory work of the Ministry of Interior, aiming to improve the regulatory work of the Ministry of Interior, ensure its content quality, and promote the organization, implementation, and enforcement of regulations to achieve high efficiency and high effectiveness throughout the entire field of internal affairs.

Article 2

Standards for the Formulation and Amendment of Ministry of Interior Regulations. The standards for the formulation and amendment of Ministry of Interior regulations refer to the formulation and amendment of regulations or various rules with complete and systematic constituent elements according to the standard levels set by the Ministry of Interior, namely: The formulation and amendment of regulations by the Ministry of Interior must comply with the six basic principles for regulation formulation as stipulated in the Law on Regulation Formulation and related rules; the formulation and amendment of regulations must be based on a clear formulation/amendment plan and be accompanied by a budget plan approved by higher authorities to ensure work implementation; must possess a content structure that meets comprehensive standards and specialized technical standards for regulations; personnel responsible for regulatory work must have a certain educational background or prior experience in regulation formulation and amendment work. The formulation and amendment of regulations by the Ministry of Interior must meet regulatory impact assessment standards, and the results must show that positive impacts (+) outweigh negative impacts (-) on the national economic and social development and the obligations of the Lao People's Democratic Republic as a member of the World Trade Organization (WTO). Regulations that have been approved and promulgated by higher authorities and have general binding force must be published in the Government Gazette to take legal effect; drafts under preparation must also be similarly published to widely solicit opinions from the entire society.
