Articles

Article 1

Purpose. This Decree stipulates principles, regulations, and measures related to the management and inspection of infant food and related feeding utensils, aiming to make the implementation of such work efficient and effective, with the goal of protecting, promoting, and supporting breastfeeding, enabling infants and young children to obtain good nutrition, physical growth, and intellectual development, becoming quality human resources participating in national defense and development.

Article 2

Interpretation of Terms. The meanings of the terms used in this decree are as follows: 1. Infant, refers to a child from birth to twelve months of age; 2. Young child, refers to a child from twelve months to thirty-six months of age; 3. Complementary food, refers to food suitable for use in conjunction with breast milk, such as infant formula or follow-on formula for infants and young children aged six to thirty-six months, as well as complementary foods that can be easily prepared at home using locally available ingredients; 4. Infant formula, refers to milk or milk-like products made industrially from animals or plants in accordance with Codex Alimentarius standards, to meet the nutritional needs of infants from birth to six months, and formula for children over six months must also meet nutritional needs, as well as medical formula; 5. Follow-on formula, refers to milk or milk-like products made industrially from animals or plants in accordance with Codex Alimentarius standards, certified or recommended as suitable follow-on formula for children over six months; 6. Young child formula, refers to milk or milk-like products made industrially from animals or plants in accordance with Codex Alimentarius standards, certified or recommended as suitable follow-on formula for children over twelve months, also known as child growth formula; 7. Growth formula, refers to milk products fortified with protein and added vitamins and minerals, suitable for feeding children from twelve to thirty-six months; 8. Food packaging container, refers to packaging used to hold or wrap products for sale; 9. Producer, refers to individuals, companies, or business units engaged in the production and operation of infant and young child food and related feeding utensils, whether directly, through distribution agents, or through mutual agreement to operate the business; 10. Sale, refers to wholesale or retail buying and selling, renting, or distributing infant and young child food and related feeding utensils, including giving to individuals or families in need; 11. Marketing, refers to the sale or distribution, advertising, and direct or indirect dissemination of information about infant and young child food and related feeding utensils; 12. Marketing personnel, refers to individuals responsible for engaging in one or more types of marketing of infant and young child food and related feeding utensils; 13. Advertising, refers to any direct or indirect promotion aimed at encouraging, inducing, or promoting the purchase or use of infant and young child food and related feeding utensils, including through individuals, mass media, electronic media, posting slogans, whiteboards, or other means; 14. Promotion, refers to any direct or indirect act of persuading individuals, legal persons, and organizations, guiding mothers or caregivers to purchase or use infant and young child food and related feeding utensils, whether or not brand names are mentioned; 15. Logo, refers to marks and images indicating the name of a company or product; 16. Label, refers to marks, images, or text affixed to food packaging containers, intended to provide information about infant and young child food and related feeding utensils, their use, storage, producers, and sellers; 17. Medical infant formula, refers to medical formula used for treating infants and young children.
