Article 1
Article 1 (Amendment) Purpose
This Law stipulates principles, systems, and measures for the collection, receipt, payment, management, and use of litigation costs, ensuring uniformity nationwide, in order to create conditions and facilitate the work of investigative agencies, people’s procuracy, people’s courts, and court judgment enforcement agencies, aiming to guarantee timely, open, and fair case handling.
Article 2
Article 2. (Amended) Litigation Costs
Litigation costs refer to amounts payable by parties or third parties, including: litigation security deposits, case-handling expenses, expenses for persons summoned to participate in litigation, document fees and appeal fees, and fees payable by the losing party in accordance with a final judgment of the court.
Article 3
Article 3 (New) Interpretation of Terms
The terms used in this Law shall have the following meanings:
1. Civil litigation costs refer to litigation costs in civil, commercial, family, child, labor, and administrative cases;
2. The subject matter amount for calculating the litigation costs of the losing party refers to the sum of the claim amount in the lawsuit plus the counterclaim amount;
3. Court decisions refer to court orders, rulings, decisions, and judgments;
4. Final court decisions refer to decisions of the Provincial People's Court and the Supreme People's Court that revoke trial-level judgments, where the plaintiff, defendant, or third party has not filed an appeal or application for annulment, or the People's Procuratorate has not filed a protest;
5. Litigation cost collectors refer to court cashiers, state officials and civil servants of the People's Procuratorate, and court judgment enforcement personnel responsible for collecting litigation costs;
6. State financial institutions refer to the Ministry of Finance, the Bank of the Lao People's Democratic Republic, and other state financial institutions.
