Article 1
Purpose. This Regulation establishes the principles, regulations, and procedures for handling technical registration of pesticides in the Lao People's Democratic Republic, in order to ensure the quality and safety of pesticides, aiming to protect humans, animals, plants, and the environment from risks associated with the use of unregistered pesticides, and to contribute to the development of clean, green, and sustainable agriculture.
Article 2
Pesticide Technical Registration. Pesticide technical registration refers to the process of recognizing a pesticide product through technical registration, based on the evaluation of scientific data to confirm that the product is effective against the target and poses no risk to humans, animals, plants, and the environment. Pesticide technical registration is divided into the following three categories: 1. Provisional Pesticide Technical Registration; 2. Permanent Pesticide Technical Registration; 3. Duplicate Pesticide Technical Registration.
Article 3
Definition of terms. The terms used in this Agreement shall have the following meanings: 1. "Decree" refers to the Government's Decree No. 258/ND-CP on pesticide management, promulgated on August 24, 2017; 2. In addition to those specified in Article 17 of that Decree, it also refers to biological pesticides or substances derived from nature, which can be formulated and used like ordinary chemical pesticides for short-term pest control; 3. "Pesticide product" refers to active ingredients and other ingredients that have been processed and packaged into containers for sale; 4. "Acute toxicity" refers to the effects resulting from a single or multiple exposures to a toxic substance within a short period (or less than twenty-four hours); 5. "Hazard" refers to the specific properties of a chemical substance or microorganism that may cause harm to property, the health of humans, animals, and plants, and the environment; 6. "Toxicity" refers to the physical and biological specific properties of a chemical substance that can cause harm or damage to living organisms (excluding mechanical aspects); 7. "Phytotoxicity" refers to the harmful effects of a chemical substance on plants; 8. "Maximum residue limit" refers to the maximum quantity of pesticide residues officially acceptable in agricultural products, food, or feed; 9. "Risk" refers to activities that may have negative impacts on the health of humans, animals, plants, or the environment and lead to harm from pesticides; 10. "Provisional pesticide technical registration" refers to the technical recognition process for pesticide products that are being produced or imported for the first time, or are in the stage of efficacy testing; 11. "Permanent pesticide technical registration" refers to the technical recognition process for pesticide products that have detailed results of domestic efficacy tests and a technical correctness assessment report; 12. "Duplicate pesticide technical registration" refers to the technical recognition process for the same type of pesticide product that has already undergone permanent pesticide technical registration, subsequently allowing other applicants to apply based on a power of attorney issued by the original registration holder; 13. "Pesticide technical registration unit" refers to the Regulatory Division of the Plant Protection Department under the Ministry of Agriculture and Rural Development; 14. "Prior informed consent procedure" refers to the international procedure for information exchange, notification, or handling of banned or severely restricted chemicals and pesticide mixtures with serious hazards, in accordance with the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade.
