Article 1
Purpose. This Decision stipulates the steps and methods for technical negotiations on market access, management of the phytosanitary system, and phytosanitary certification for the export and re-export of plants, plant products, and regulated articles, to comply with Lao laws and regulations and the phytosanitary requirements of importing countries, aiming to protect agricultural production and facilitate trade, thereby contributing to the socio-economic development of the country.
Article 2
Phytosanitary measures for the export and re-export of plants, plant products, and regulated articles. Phytosanitary measures for the export of plants, plant products, and regulated articles involve implementing measures prescribed by the importing country or relevant international standards for phytosanitary measures at all stages of production of the exported plants, starting from pest risk management in the production area and post-harvest phytosanitary treatment, up to pre-export treatment, inspection, phytosanitary certification, and technical negotiations for market access. Phytosanitary measures for the re-export of plants, plant products, and regulated articles involve applying phytosanitary measures to goods originating from one country and then re-exporting them to another country, such as conducting inspection, treatment, and phytosanitary certification for the re-export of goods that have undergone storage, separation, consolidation with other goods, or repackaging.
Article 3
Terminology. The terms used in this Decision shall have the following meanings: 1. Law means the Law on Plant Protection and Quarantine (Amended Version), No. 13/National Assembly, dated November 15, 2016; 2. Contaminant means a pest or any regulated article mixed into goods, storage premises, transport containers, or shipping containers, but not originating from an infestation of the place of origin of the goods; 3. Certification means the verification of correctness and conformity in accordance with phytosanitary procedures and methods to formally issue a phytosanitary certificate; 4. Re-export phytosanitary certificate means an official certification document in paper or electronic form conforming to the format specified in the relevant provisions of the International Plant Protection Convention; 5. IPPC (International Plant Protection Convention) means the International Plant Protection Convention (1997 Revised Version); 6. NPPO (National Plant Protection Organization) means the Department of Agriculture, which is the representative body of the Lao National Plant Protection Organization as specified in the relevant provisions of the Law; 7. Infestation means the spread of living pests (including insects and pathogens) on plants, plant products, and regulated articles within the goods; 8. Production site means a farm, factory, silo, or premises used for planting, harvesting, sorting, processing, loading, packaging, or storing plants, plant products, and regulated articles for the purpose of export; 9. Treatment means the elimination, suppression, or separation of pests, or other official methods that render pests sterile, weakened, or incapable of further growth through a process, such as spraying to kill pests or infectious plant diseases, applying temperature, fumigation, chemical substances, chemical agents, or vacuum; 10. Fumigation means an activity of treatment using chemical substances or gases that can permeate the entirety of the goods.
