Article 1
Issuance of Business Licenses. Any enterprise that has obtained enterprise registration from the Industry and Commerce sector and intends to operate in the fields under the responsibility of the Ministry of Public Works and Transport, according to the business types specified in the Lao People's Democratic Republic Economic Classification (ISIC), must first apply for a business license from the Public Works and Transport sector before the enterprise may engage in activities within the scope of the business specified in such license. A business license is a document issued by the Public Works and Transport sector to an enterprise, certifying its rights and obligations to operate a specific business for which a business license application is required.
Article 2
Hierarchical Management of Business License Issuance in the Public Works and Transport Sector. 1) Central Level: The Planning and Cooperation Department of the Ministry of Public Works and Transport is responsible for managing, reviewing, and issuing business licenses for foreign-invested and domestic activities, state enterprises, joint ventures with foreign entities, and wholly foreign-owned enterprises; 2) Provincial Level: The Department of Public Works and Transport of the province or capital may accept applications and review and issue General Business Licenses (GBL) nationwide and within the respective province; 3) District Level: The Office of Public Works and Transport of the district may accept applications and review and issue General Business Licenses (GBL) within the respective province and district; if a district lacks the capacity to issue business licenses under the above conditions, the matter shall be referred to the Department of Public Works and Transport of the province or capital for study, review, and issuance on its behalf. The specific types of professional activities under the responsibility of the Public Works and Transport sector and detailed hierarchical management shall comply with the regulations of the relevant authorities.
Article 3
Signatories for Business Licenses in the Public Works and Transport Sector. 1) Central Level: The Director or Deputy Director of the Planning and Cooperation Department of the Ministry of Public Works and Transport, or a delegated person, shall sign the business license; 2) Provincial Level: The Director or Deputy Director of the Provincial or Capital Public Works and Transport Department, or a delegated person, shall sign the business license; 3) District Level: The Director or Deputy Director of the District Public Works and Transport Office, or a delegated person, shall sign the business license.
