Article 1

Purpose. This Decision stipulates principles, regulations, and measures concerning the management of urban construction and construction works to ensure that applicants for permits receive convenient, comfortable, prompt, and transparent services, while simultaneously ensuring that buildings are orderly, aesthetic, safe, hygienic, distinctive, harmonious with the surrounding environment, and in compliance with urban planning.

Article 2

Construction Management. Construction management refers to the organization, implementation, research, and review process of issuing construction permits, supervising, and tracking construction activities to ensure compliance with permit requirements. All construction activities within urban areas must obtain permits in accordance with laws and regulations, and construction may only commence after obtaining a construction permit.

Article 3

Interpretation of Terms. The terms used in this Decision shall have the following meanings: 1. Building construction refers to the construction, installation, repair, demolition, expansion, change of use, renovation, and reconstruction of buildings; 2. Construction (new construction) refers to the assembly of various building materials to create a new building on vacant land or on a plot where the original building has been demolished; 3. Installation refers to the assembly of structures and components such as electrical systems, telecommunications, billboards, water supply pipelines, and columns; 4. Repair refers to the renovation, alteration, change of appearance, patching of damaged or worn parts, and partial demolition of a building; 5. Expansion refers to increasing the area or volume of an existing building; 6. Change of use refers to altering the functional purpose of a building for which a construction permit has been obtained to another use; 7. Renovation refers to the process of repairing while preserving the original form, pattern, and details of a building, and supplementing missing parts; 8. Reconstruction (restoration) refers to the re-repair of objects or buildings with historical, cultural, or natural landscape value to restore them to their original state and features; 9. Building refers to the product of construction works, such as houses, technical and social infrastructure system components, which may be located on the ground, on water, underground, or underwater; it is classified into three categories by scale: (1) Large, with an area of 10,000 square meters or more; (2) Medium, with an area of 400 to 10,000 square meters; (3) Small, with an area not exceeding 400 square meters. 10. Controlled building refers to large buildings serving a large number of the public, high-rise buildings exceeding 20 meters in height, and buildings with risks; 11. Construction site leveling refers to excavating or filling soil within the proposed construction plot to achieve the required elevation; 12. Urban planning certificate refers to a document providing information on the designated land use plan in the state-approved urban plan; 13. Agreement with adjacent parties refers to a certification document of consent from the owners of land plots adjacent to the plot of the person applying for construction; 14. Initial inspection refers to an inspection conducted to ensure the correct staking out of the planning project according to the established red lines and plot boundary lines; 15. Intermediate inspection refers to an inspection conducted to ensure the correct implementation of various construction works according to the approved plan; 16. Final inspection refers to an inspection of a building completed according to the approved plan, serving as the basis for issuing a building compliance certificate.
