Article 1
Purpose. This Decision stipulates the rights and duties regarding the decentralized management and supervision of processing industry and handicraft factories, for the issuance of business licenses, operation activity licenses, renewals and expansions of factories, chemical business licenses, chemical ledger registrations, and permits for the installation of wastewater treatment and discharge systems, as well as for tracking and supervising nationwide the technical standards, raw materials, products, safety and hygiene, environment, chemicals, and operation conditions of processing industry and handicraft factories.
Article 2
Hierarchical Management of Processing Industry and Handicraft Factories. The hierarchical management of processing industry and handicraft factories is divided into three levels, namely: 1. The central level is the Department of Industry and Handicraft, which is directly responsible for and leads coordination with relevant departments, managing processing industry and handicraft factories nationwide according to its functions; 2. The provincial level is the Provincial and Vientiane Capital Department of Industry and Commerce, which is directly responsible for and leads coordination with relevant departments, managing processing industry and handicraft factories within the province and Vientiane Capital according to its functions; 3. The district level is the District and City Office of Industry and Commerce, which is directly responsible for and leads coordination with relevant departments, managing processing industry and handicraft factories within the district and city according to its functions.
Article 3
Rights and Duties of the Department of Industry and Handicrafts. The Department of Industry and Handicrafts has the following rights and duties: 1. Issuing, amending, suspending, revoking, and canceling licenses for large, medium, and small enterprises listed in the category requiring permits from the Ministry of Industry and Commerce; 2. Issuing, amending, suspending, revoking, and canceling operating licenses, renewals, and expansions for large factories in accordance with factory management decisions and the control list of the Ministry of Planning and Investment, coordinating case by case with relevant departments and local administrative authorities as necessary; 3. Issuing, suspending, revoking, and canceling chemical business licenses and chemical substance ledgers; 4. Issuing factory product certifications in accordance with Articles 4 and 63 of the Standards Law; 5. Issuing certifications for wastewater treatment and discharge systems of large factories in accordance with laws and relevant regulations; 6. Approving the import and export of Category 2 and Category 3 hazardous chemicals and hazardous waste, and certifying their transit; 7. Certifying the import of raw materials, machinery, machinery parts, vehicle parts, and equipment for factory construction and production for large factories based on technical-economic feasibility reports, and reviewing and certifying annual production plans, improvement plans, and expansion plans; 8. Managing, monitoring, and overseeing technical standards, raw materials, products, safety and hygiene, the environment, chemicals, and factory operations nationwide.
