GUIDANCE
on the Development of a System for Legal Verification of Timber
- Pursuant to the Forestry Law No. 06/NA, dated 24 December 2007;
- Pursuant to the Prime Minister's Decree No. 99/PM, dated 09 March 2017, on the Organization and Operation of the Ministry of Agriculture and Forestry;
- Pursuant to the Prime Minister's Agreement No. 65/PM, dated 19 August 2015, on the Establishment of the National Steering Committee for the Implementation of the Voluntary Partnership Agreement (VPA) and Forest Law Enforcement, Governance and Trade (FLEGT);
- Pursuant to the Ministry of Agriculture and Forestry Agreement No. 1868/MAF, dated 09 March 2016, on the Establishment of the Committee for the Development and Support of Negotiations and the Technical Coordination Committee for the Implementation of the Voluntary Partnership Agreement between the Lao PDR and the European Union, and Forest Law Enforcement, Governance and Trade.
To ensure uniformity in the implementation of the Forest Law Enforcement, Governance and Trade process for the Voluntary Partnership Agreement between the Lao PDR and the European Union to achieve tangible results, and to ensure strict implementation of the management of forests, timber harvesting, timber import, labor utilization, timber processing, domestic use of timber and timber products, and export, based on the promulgated laws and other legislation. As well as to prevent and suppress illegal logging and illegal timber trade, and to gradually reduce and eliminate such acts.
The Minister of Agriculture and Forestry hereby issues the following guidance:
Article 2
Article 1: The Negotiation Support Development Committee, the Technical Coordination Committee, the Thematic Expert Groups, and the FLEGT Standing Office are assigned to develop the Timber Legality Assurance System, with active participation from relevant ministries, the National Assembly, technical experts, civil society organizations, timber businesses, and local authorities.
Article 3
Article 2: The objective of developing the Timber Legality Assurance System is to ensure and certify that timber and timber products have been harvested, processed, and traded in compliance with laws and regulations. The Timber Legality Assurance System shall comprise the following key components:
2.1 Definition of the legality of timber and timber products, as specified in Annex 1;
2.2 Methods for controlling the supply chain of timber and timber products from the harvesting source or point of import to the domestic market or export market;
2.3 Procedures for verifying the legality of timber and methods for controlling the supply chain of timber and timber products in accordance with laws and regulations;
2.4 Procedures for issuing permits for legally compliant timber for domestic trade and export;
2.5 Procedures for independent monitoring to oversee the implementation of the TLAS in compliance with all stipulated requirements.
