Article 1
Purpose and Scope. Approval is granted for the principles and regulations on compensation regarding land use rights, land utilization rights, buildings, crops, and other developments within the reserved area of the 115 kV high-voltage transmission line construction project (from Nahai Substation to Dongphosi Substation, Vientiane Capital), in order to mobilize residents affected by the project to understand and acknowledge the government's development policies and sincerely participate in construction and development; aiming to ensure that affected persons receive compensation for losses, relocation, and resettlement, and that their living conditions are reasonably improved or maintained compared to the past, in accordance with the provisions of Decree No. 84/ລບ dated April 30, 2016, on Compensation for Losses and Resettlement of Residents Caused by Development Projects, serving as the basis for research, data collection, and determination of compensation unit prices for affected persons.
Article 2
Compensation Principles and Reserved Areas. 2.1 Principles for determining the unit compensation price, i.e., taking the average of actual transaction data from each area and the current land valuation used for land use rights transfer registration, as per Agreement No. 352/ສນຍ.ອຄດຊ dated May 31, 2011, and Document No. 0775/ຈນວ (Nabon-Nam Ngum 1-Hin Heup 230 kV High Voltage Transmission Line Construction Project) dated August 5, 2015, as the compensation price. 2.2 Reserved area for the 115 kV (Nahai Substation to Dongphosi Substation, Vientiane Capital) High Voltage Transmission Line Construction Project, with a total length of 9.2 kilometers, a transmission line corridor width of 25 meters, an affected area of 230,000 square meters under the line corridor, 32 towers, an affected area of 846 square meters at tower foundations, affecting 44 households in 4 villages across 2 districts, namely: 2 villages in Hatsayfong District—3 households in Nahai Village, 2 households in Dongphosi Village; 2 villages in Saysettha District—27 households in Dongkhamxang Village, 12 households in Xiangda Village; these areas shall be designated as project reserved areas. For land remaining after compensation and return, the project party shall bear the cost of remediation and issue new land titles for the remaining portion to the affected persons; regardless of the amount of remaining land, it remains an asset of the affected persons' lawful use and utilization rights under the law. The project shall determine compensation principles for buildings and crops so that affected persons can use the compensation funds to relocate, move buildings, and cut down trees for continued use, and must complete this within the timeframe set by the project. 2.3 Unit compensation price for land use and utilization rights.
