Article 1
Pursuant to the Law on Investment Promotion (No. 14/NA, November 17, 2016); Pursuant to the Prime Minister's Decree on the Organization and Operation of the Ministry of Planning and Investment (No. 201/PM, June 30, 2017); Based on the research and recommendations of the Investment Promotion Department. The Minister of Planning and Investment hereby decides as follows.
Article 2
Purpose. This Decision stipulates the conditions, regulations, and procedures for the payment of deposits, refund of deposits, forfeiture of deposits, and re-payment of deposits for concession investment projects, applicable to concession projects under the Investment Promotion Law, primarily including: land development, special economic zone development, export processing industrial zone development, mineral development, energy development, as well as aviation and telecommunications concessions, and other projects specified by the government in the list of concession projects.
Article 3
Payment of Performance Bond. Payment of a performance bond refers to the payment of a bond to the government to guarantee the performance of memoranda of understanding, concession project contracts, mineral-related projects conducted under investment licenses, and other projects specified by the government in the list of concession projects.
