Article 1
Purpose. This guidance expands upon and provides implementation instructions for certain provisions of the Law on Electronic Data Protection No. 25/National Assembly dated May 12, 2017, by supplementing explanations of technical and professional content with examples, thereby making the law more detailed, clear, and easier to understand and apply, with the aim of ensuring the correct, effective, and efficient organization and implementation of the law in a unified manner nationwide.
Article 2
Interpretation of Article 8 "Electronic Data". Electronic data refers to texts such as digits, characters, dynamic images, static images, sounds, and videos preserved in electronic form, including data of individuals, legal persons, and organizations, as well as confidential, security-related, copyright-protected data, and other data. The aforementioned data is divided into two categories: data that can be disclosed is called "general data", and data that cannot be disclosed is called "specific data". Therefore, the Electronic Data Protection Law, with the unanimous agreement of various industries, stipulates that data includes two categories, namely: general data and specific data.
Article 3
Interpretation of Article 9 "General Data". General data refers to data that individuals, legal persons, or organizations can access, use, and disclose, provided that the data source is correctly attributed. Examples: personal data such as name, position, address, telephone number, email address, organizational data, general statistical data, promotional articles in professional fields, etc.
