Article 1

Town entity, city entity refers to the urban area of a town or city, which is a place where communities live, characterized by: — Being the location of provincial-level and district-level administrative agencies and key economic-social areas; — A population density of 450 people per square kilometer in towns; — A population density of 900 people per square kilometer in cities; — Possessing a system of public welfare and public utilities, such as: roads, drainage systems, schools, hospitals, stadiums, parks, tap water or clean water, electricity, telephones, etc. The scope of the town entity or city entity shall be determined according to the scope established by urban planning.

Article 3

Procedures and Material Compilation for Establishing Towns and Cities. 1. Establishment Procedures: The establishment of towns and cities shall follow these steps: 1) The provincial governor or the mayor of the capital city issues a decision appointing a responsible committee to prepare for the establishment of the town or city; 2) The responsible committee prepares all necessary materials and data, such as revenue and expenditure plans, organizational structure, personnel, and other information, as a basis for researching and drafting an analysis report; 3) The provincial governor or the mayor of the capital city submits a proposal to the provincial People’s Council for consideration and approval regarding the establishment of the town or city; 4) The provincial governor or the mayor of the capital city submits the proposal documents for establishing the town or city to the Government through the Ministry of Internal Affairs. 2. Compilation of Establishment Proposal Materials: The establishment proposal materials include: 1) The proposal for establishing the town or city submitted by the provincial or capital administrative agency to the Ministry of Internal Affairs; 2) The resolution of the provincial People’s Council approving the establishment of the town or city; 3) The decision of the provincial governor or the mayor of the capital city appointing the responsible committee for preparing the establishment of the town or city; 4) The analysis report.
