Decision on Determining Compensation Prices for Damages to People Affected by the Construction Project of the Laos-China Railway (Section Passing Through Luang Prabang Province, 80 km Long)

Article 1

Agreed and adopted the unit prices for compensation of damages to affected people from the Laos-China railway construction project passing through Luang Prabang province, with a total length of 80 kilometers, details as follows:

[. Principles for calculating unit compensation prices
1.) Paddy fields: take the land appraisal zone price plus the calculation of opportunity cost lost from rice farming each year multiplied by five years according to the calculation formula.
2.) Garden land, construction land prices: based on the agreement of the Provincial Governor which has compensated each project as per the consensus previously researched.
8.) Industrial timber, fruit trees, fruit-bearing and oil-bearing plant types are calculated: compensation value (land clearing cost + seedling cost) + (maintenance cost: number of years) + (yield/tree/kg x price).
4.) Various construction prices: agree to calculate according to the regulations of the Urban Planning Department, while the price of planted crops is calculated according to the compensation of various projects within the province.
5. Type of paddy fields: Compensation value > Average productivity of paddy fields in 1 season (tons/year/hectare) > Affected area... Actual paddy price (kip/ton): 5 (years) + land price - The calculation is based on current market productivity and price as the main principle... Paddy fields in urban areas have 3 types:
- Type 1. Compensation value > 8 tons/hectare + 4,000,000 kip x 5 years < 160,000,000 + land appraisal zone price 250,000,000 > 410,000,000 kip/1 hectare.
- Type 2. Compensation value 4 tons/hectare: 4,000,000 kip x 5 years > 80,000,000 + appraisal zone price 130,000,000 < 210,000,000 kip.
- Type 3. Compensation value 4 tons/hectare: 4,000,000 kip x 5 years < 80,000,000 + appraisal zone price 80,000,000 > 160,000,000 kip.
- Paddy fields cultivated for 9 years or more but paying tax every year: 1 hectare price 70,000,000 kip
- Paddy fields cultivated for 3 years or more but paying tax every year: 1 hectare price 50,000,000 kip
0. Type of garden land: Remarks:
- For land without certification documents but still used by people for production, compensation is the same as garden land with certified rights.
- Garden land without planted crops is calculated at 1 square meter > 3,000 kip.
- Garden land for upland rice cultivation (swidden) if there are documents certifying annual land tax payment, compensation 1 hectare > 5,000,000 kip
