The Governor of Attapeu Province, in implementation of the Prime Minister's Directive No. 15/PM, issued an instruction assigning five districts and departments of agriculture, finance, industry and commerce to form a task force to inspect, eliminate illegal collection, hoarding, trading, transfer, and possession of timber and related collusive activities, and to investigate and prosecute illegal wood processing factories and illegal holders of timber and minerals, in order to curb illegal timber activities in the province.
Articles
Article 1
To: All provincial departments, agencies, five district administrative organs, and village organizations surrounding the districts. Basis: Article 20, Section 4 of the amended Law on Local Administration of the Lao People's Democratic Republic, No. 68/NA (December 14, 2015), concerning the rights and duties of the Provincial Governor; the Prime Minister's Directive No. 15/PM (May 13, 2016) on strengthening the management and inspection of timber extraction, timber transfer, and timber business; the resolution of the joint meeting of the Provincial Party Standing Committee and the Provincial Military-Public Security Committee on September 5, 2017. Previously, this province issued an instructive directive (No. 606/Provincial Office, June 22, 2016) on implementing the Prime Minister's Directive No. 15/PM on strengthening the management and inspection of timber extraction, timber transfer, and timber business. From the implementation of this directive up to the present: results have been limited; relevant state sectors have been weak and enforcement insufficient; illegal activities of buying, selling, transferring, and possessing timber persist, with increasing signs, causing instability within the province. Therefore, to curb, prevent, and eliminate the aforementioned undesirable phenomena, in accordance with the spirit of Directive No. 15/PM, strict implementation with tangible results is required, and the Provincial Governor issues the following directive:
Article 2
Conduct inspections, crackdowns, and suppression of illegal collection, hoarding, buying, selling, transfer, possession of timber, and collusive fraudulent activities; particularly, rectify various substandard processing factories, unlicensed sawmills, and veneer mills, and completely dismantle them; initiate legal proceedings against factories that exploit loopholes, use the names of individuals and organizations to illegally purchase timber for processing, or have been shut down but become hiding places for timber by criminal groups; inspect existing timber hoarding points within 5 districts; inspect the situation of villagers illegally possessing timber.
Article 3
Assign the district governors of the 5 districts as the centers for organizing implementation; the Department of Agriculture and Forestry, the Department of Finance, and the Department of Industry and Commerce shall each send their personnel to the districts to cooperate, with two specialized teams established: 2.1 First specialized team: Inspect and thoroughly register processed timber in each factory, to be completed from the date of this directive until October 30, 2017; if any factory is found to have purchased non-compliant timber, it shall be dealt with in accordance with laws and regulations. 2.2 Second specialized team: Continue to inspect and cease the operations of unlicensed sawmills, sawmills, and veneer factories; this work must be completed by November 30, 2017. Assign each district governor to issue a notice and publicize, explain, and educate the public, staff, military personnel, police, foreign residents, foreigners, and other operators: from December 1, 2017, the district will conduct inspections to uncover illegal possession of forest resources (planks, various types of logs) and minerals (such as washed stone or others); if violations are found during inspection, the items shall be confiscated and forfeited, and legal proceedings shall be initiated.
