Articles
Article 1
Purpose. This Decree stipulates rules and methods for handling labor disputes, aiming to protect the rights and interests of workers and employers in accordance with laws and regulations, and to ensure effective prevention and resolution of issues arising from labor activities.
Article 2
Handling of labor disputes. Labor dispute handling is a process of negotiation between workers and employers to seek a resolution and jointly settle the dispute, or handling by a third party. Labor dispute handling includes: handling by conciliation, administrative handling, handling by the Labor Dispute Handling Committee, court adjudication, and handling of disputes of an international nature.
Article 3
Definition of terms. The terms used in this Decree have the following meanings: 1. Labor dispute: refers to a disagreement between an employer and a worker that cannot be reached on labor issues; 2. New rights and interests: refer to rights and interests not provided for in the labor law, individual and collective labor contracts, internal regulations of the employing unit, and other labor legal documents; 3. Third party: refers to the labor work management authority, the labor dispute settlement committee, and the court; 4. Labor work management authority: refers to the Ministry of Labor and Social Welfare, the Provincial Department of Labor and Social Welfare, the District Office of Labor and Social Welfare, and the Village Labor and Social Welfare Unit; 5. Enterprise group: refers to employing units engaged in the same type of business, production, and services.
