Articles
Article 1
For drug-related cases occurring from April 17, 2018, the Law Amending Article 146 of the Penal Code and Articles 75 and 76 of the Drug Law (2012 Revised Version) shall apply to the adjudication of such cases.
Article 2
If it is found that the initiation of a public prosecution by the responsible person of the People's Procuratorate in a drug case is inconsistent with this Guiding Opinion, coordination and cooperation with the procuratorial organ shall be re-established to ensure that the public prosecution complies with legal provisions. Upon receipt of this Guiding Opinion, please communicate and publicize it to relevant personnel with related responsibilities, so as to jointly and strictly implement this Guiding Opinion. This Guiding Opinion shall take effect from the date of signing.
