Article 1
Purpose. This Protocol stipulates the principles, regulations, and measures for managing direct selling businesses to ensure their lawful and compliant operation, aiming to facilitate the sale of goods to society, safeguard the overall interests of the state, protect the rights and interests of consumers, independent salespersons, direct selling agents, and direct selling operators, and to promote job creation, increase income, and improve people's livelihoods.
Article 2
Direct Selling Business. Direct selling business refers to business activities that sell goods directly to consumers through door-to-door methods, delivering to consumers' residences and various locations.
Article 3
Definition of Terms. The terms used in this Protocol shall have the following meanings: 1. Consumer refers to an individual, legal person, or organization that lawfully purchases and uses goods and services, not for commercial purposes; 2. Direct selling operator refers to a business entity that supplies goods to direct selling agents or independent salespersons; 3. Business entity refers to an enterprise or commercial organization established by an individual or legal person, with a name, capital, management, business premises, and registered in accordance with the Enterprise Law; 4. Direct selling agent refers to a person who supplies goods to independent salespersons or sells goods directly to consumers; 5. Independent salesperson refers to a person who sells goods directly to consumers; 6. Compensation plan refers to a marketing plan or scheme formulated by a direct selling operator to determine the method of paying compensation to members, clearly specifying the payment method; 7. Trade secret refers to information concerning processes, production methods, operations, or services that is of significant importance to business activities; 8. Direct selling business performance bond refers to funds deposited by a direct selling operator to conduct direct selling activities, used to provide guarantees to persons participating in the direct selling business.
