Article 1
Purpose. This Agreement stipulates the plans, principles, regulations, and measures concerning the management and development of the Don Chan area along the Mekong River in Vientiane City, aiming to make this area a development zone with the highest efficiency and sustainability, in harmony with the landscape, permanently protecting the riverbank (preventing bank collapse), protecting the ecosystem of Don Chan beach, and being able to respond to future climate change.
Article 2
Done Chan Riverside Area along the Mekong River. The Done Chan Riverside Area along the Mekong River is a special riverside zone in Vientiane Capital, over 12 kilometers in length, comprising the following parts: the Mekong River waters, Done Chan sandbank area, embankment protection area, park area, and surrounding commercial activities. The Done Chan Riverside Area along the Mekong River is also designated as a city highlight zone along the Mekong River, to be developed, utilized, and managed in accordance with a comprehensive plan to ensure efficiency, sustainability, and harmony with the natural landscape and the modern culture of Vientiane citizens.
Article 3
Definition of Terms. The meanings of the terms used in this Agreement are as follows: 1. Engaging in construction and business activities in the Dong Chan area along the Mekong River refers to identifying national or private investment projects and carrying out construction operations, such as: surveying, construction, repair, expansion, renovation, addition, landfilling, setting up shops for sales, installing billboards, demolition, management, inspection, and monitoring of construction projects on the water. 2. Changing the natural state of the Dong Chan area along the Mekong River refers to alterations to the riverbank, ground surface, water flow, and other ecological conditions due to human activities, such as: excavation, extraction of sand, gravel, and black soil, reinforcement of riverbanks with fill soil and rocks, pouring concrete, constructing platforms, driving piles, discharging wastewater, and natural evolution of water sources. 3. Activities within the water area refer to various activities held in the Mekong River waters within the Dong Chan area along the Mekong River (from Dan Kham Village, Xikodabang District to Pillar No. 3, Vana Village, Xisadana District), such as: traditional boat races, tourist boats, building rafts, installing water pumps, passenger vessel navigation, private boats (traditional local flat-bottomed boats, motorboats, and other vessels...). 4. Land-based activities refer to various activities held on the sandbanks, slope areas, and the top of the riverbank protection embankment. 5. The top area of the riverbank protection embankment (anti-collapse dike) refers to the scope of the first section where riverbank protection and anti-collapse facilities are constructed, including the road serving as the top of the embankment. Parks and reserved areas on land within the Dong Chan area along the Mekong River. 6. The slope area of the riverbank protection embankment refers to the scope from the top of the embankment down to the sandbank where riverbank protection and anti-collapse facilities are constructed (steep slope area and toe area). 7. The water area refers to the area extending from the lowest or highest water level point in the Dong Chan area along the Mekong River outward to the Lao-Thai border. 8. Construction projects on the Mekong River waters refer to projects implemented by the state or private entities on the water, in the water, or on the banks of the Mekong River in the Dong Chan area for construction and business purposes, such as: constructing water transport channels, piers, boat and raft docks, dredging navigation channels, and boat and raft restaurants. 9. Sandbank area refers to the area of sandbanks formed by natural deposits of sand, gravel, sand, black soil, etc.
