Articles

Article 1

Purpose. This Agreement is formulated pursuant to Articles 33, 34, 37, 38 and 48 of the Law on Tobacco Control (No. 07/NA, dated November 26, 2009), aiming to ensure the effective and uniform implementation nationwide of establishing smoke-free places, printing health warnings on tobacco product packaging, and prohibiting tobacco product advertising.

Article 2

Interpretation of Terms. In addition to the terms used in the Tobacco Control Law (No. 07/National Assembly, dated November 26, 2009), some terms require supplementary interpretation as follows: 1. Consumption of tobacco products refers to inhaling, puffing, sucking, or otherwise using through the mouth or nose; 2. Electronic tobacco product (e-cigarette or electronic cigarette) refers to an electronic cigarette containing volatile nicotine, consumed via electrical energy. Such e-cigarettes come in various types, some resembling pipes, others resembling small tubular objects like ballpoint pens; 3. Water tobacco product (shisha) refers to a smoking device that consumes volatile nicotine dissolved in water through an electrical system, entering via a pipe into the mouth. In addition to nicotine, flavoring substances are mixed in, such as various fruit flavors, leading people to mistakenly believe it is a local tobacco product and harmless to health; 4. Inside a building refers to any place with a roof covering, or enclosed by walls or without walls, regardless of whether the walls are permanent or temporary; 5. Toxic substances and carcinogens in tobacco smoke: A) Toxic substances: 1) Carbon monoxide, the same substance as in vehicle exhaust, impedes oxygen transport throughout the body, causing cardiovascular disease and death; 2) Hydrogen cyanide, a toxic gas that damages the bronchi and alveoli of the lungs, causing phlegm and coughing, is a cause of chronic bronchitis and death; 3) Nicotine, an addictive substance found only in tobacco leaves, narrows and blocks arteries, causing cardiovascular disease and death, and is used in manufacturing insecticides; 4) Ammonia, the same substance as in toilet cleaners, irritates the eyes and nose, is a cause of bronchitis and death; 5) Nitrogen dioxide, a gas that damages the mucosa of the bronchi and alveoli, causing chronic obstructive pulmonary disease and death; 6) Arsenic, used as an ingredient in rat poison, enters the body through the mouth or respiration, damages the digestive system and other parts of the body, ultimately leading to death. B) Carcinogens: 1) Tar, the same substance as in road asphalt, accumulates in the lungs, is a primary cause of lung cancer and chronic bronchitis, and leads to death; 2) Formalin (formaldehyde), a preservative used for embalming corpses, is a cause of cancer and death; 3) Nitrosamines, a preservative substance, cause cancers of the liver, kidneys, esophagus, and stomach, and lead to death. Article 3

Placement of No-Smoking Signs. Pursuant to Articles 37 and 38 of the Tobacco Control Law regarding smoke-free places: 1) Smoke-free places must post no-smoking signs or notices; 2) No-smoking signs must be posted in open, visible, and clear locations, particularly at the entrances of such places; 3) No smoking means the prohibition of smoking all types of tobacco, including e-cigarettes (e-cigarette or electronic cigarette) and waterpipes (shisha).
