Articles
Article 1
Purpose. This Decree stipulates the principles, regulations, and measures for the management, monitoring, and inspection of loss compensation and resettlement for development projects, to ensure their correct and effective implementation, aiming to guarantee that affected persons receive assistance in loss compensation, resettlement, stable employment, and livelihood improvement, enabling them to have a better life than before or at least equivalent, while also enabling such projects to contribute to the sustainable development of the national economy and society.
Article 2
Compensation for losses. Compensation for losses refers to the compensation for land, buildings, crops, livestock, and income affected by development projects, based on replacement value, in the form of land, in-kind goods, or cash.
Article 3
Resettlement. Resettlement refers to the process of moving persons affected by a development project from their original place of residence to a new place of residence, and restoring their livelihoods, which must be carried out in accordance with the resettlement plan of the development project and must be agreed upon and approved by the majority of the affected persons.
