Article 1
Purpose. This Decision stipulates principles, regulations, and measures concerning the import and export of rough diamonds, to manage and promote the import and export of rough diamonds in compliance with laws and regulations, aiming to resist and curb the import and export of conflict diamonds and illegal diamond trade, thereby contributing to economic development and the maintenance of social peace.
Article 2
Import and Export of Rough Diamonds. The import and export of rough diamonds refers to the import of rough diamonds or flawed diamonds into the Lao People's Democratic Republic for processing—through grinding, cutting, splitting, rounding edges, or other finishing processes—and then re-exporting or transshipping them to a third country.
Article 3
Definition of Terms. The terms used in this Decision shall have the following meanings: 1. Rough diamonds refer to naturally formed pure carbon substances, classified as precious gemstones, or semi-finished products produced through certain synthesis, characterized by rarity, hardness, and transparency, which are diamonds that have not yet undergone processing, falling under the following 03 HS Codes: HS Code 7102.10 – Rough diamonds mined but not yet sorted; HS Code 7102.21 – Rough diamonds sorted for industrial use; HS Code 7102.31 – Rough diamonds sorted for non-industrial use. 2. International Rough Diamond Trade Management Body (Kimberley Process Certification Scheme) refers to the entity jointly established by governments and the global rough diamond industry, responsible for organizing the certification and tracking system for the authenticity of rough diamonds (Kimberley Process Certification Scheme). 3. License refers to the permit for importing and exporting rough diamonds within the Lao People's Democratic Republic, issued by the rough diamond import and export management authority. 4. Kimberley Process Certificate (KPC) refers to the certificate of origin for rough diamonds issued by the relevant competent authorities of the country of origin.
