Articles
Article 1
Assign the Departments of Industry and Trade of provinces and the capital to instruct district offices of industry and trade to disseminate and guide this order to all tobacco production factories, markets, and shops within their jurisdiction, as follows: — Control the retail prices of all types and brands of tobacco products sold in markets and shops, whether imported from abroad or domestically produced, guiding that the minimum selling price shall not be less than three thousand Kip (3,000 Kip) per pack. — Tobacco sold in markets and shops must have tax stamps affixed to each pack and each carton. — Tobacco must ensure quality, and shall not be deteriorated, degraded, or expired. — For tobacco imported from abroad, legal import documentation must be held. The dissemination and guidance of the contents of this order to all tobacco production factories, markets, and shops within the jurisdiction must be completed within 30 days from the effective date of this order.
Article 2
After the completion of publicity and guidance work, the Department of Domestic Trade and the Industry and Commerce Departments of provinces and the capital are tasked with assigning trade inspection enforcement officers to go to markets and various shops for follow-up inspections; if any violations as listed in Article 1 of this Order are found, enforcement measures shall be taken against the violators in accordance with the provisions of Article 3 of this Order, as well as the Decree on the Management of Goods and Service Prices, No. 474/PM, dated November 18, 2010, and relevant laws and regulations.
Article 3
Measures for handling violators shall be implemented as follows: 1) For the first violation, a warning shall be issued and a record shall be made for the violator to sign acknowledging the violation; 2) For a second violation, a fine of five hundred thousand Kip to one million Kip (500,000 Kip – 1,000,000 Kip) shall be imposed; 3) For a third violation, a fine of one million Kip to two million Kip (1,000,000 Kip – 2,000,000 Kip) shall be imposed, and all non-compliant tobacco products shall be seized.
