Articles
Article 1
The purpose of these "Regulations on the Management and Use of Development Assistance Funds (ODA)" is to provide a basis for the unified management and use of such funds by ministries, equivalent agencies, sector agencies, and localities nationwide, ensuring the smooth, transparent, auditable, and effective implementation of programs/projects.
Article 2
These regulations specifically apply to development assistance funds used for the implementation of plans/projects listed in the government's socio-economic development plans for each period, aiming to achieve set goals, promote economic growth, and eradicate poverty.
Article 3
Definition of Terms. The terms used in these regulations shall have the following meanings: 1) Development Assistance Funds (X.K.P): refers to official development assistance funds (loans and grants from foreign sources). 2) Executing Agency: refers to the ministry, department, agency, province, or capital responsible for managing the implementation of the program/project and monitoring the execution of the funding agreement. 3) Implementing Agency: refers to the ministry, department, agency, province, or capital responsible for executing the program/project in accordance with the agreement. 4) Authorizing Officer (Ordering Officer): refers to the Minister, head of an equivalent agency, Provincial Governor/Mayor of the Capital, who is the person responsible for organizing the implementation of the program/project within their respective sector and locality.
