Articles
Article 1
Purpose. This Agreement stipulates principles, regulations, and measures regarding the organization, monitoring, inspection, prevention, and suppression of various unfair and restrictive telecommunications business operation activities, in order to promote fair competition, protect the legitimate rights and interests of telecommunications service providers and service users, promote socio-economic development, and implement correctly, efficiently, and effectively in accordance with national strategic plans and socio-economic plans.
Article 2
Competition in the Telecommunications Sector. Competition in the telecommunications sector refers to competition among telecommunications service providers in terms of price, quantity, quality, services, promotions, advertising, and information provision. The provision of telecommunications services to service users must be fair and comply with laws, regulations, policies, strategic plans, and the socio-economic development plans of each stage of the Lao People's Democratic Republic.
Article 3
Interpretation of Terms. The terms used in this Agreement shall have the following meanings: 1. Telecommunications goods, means telecommunications resources, telecommunications equipment, and other items used by service providers as goods for sale to telecommunications service users; 2. Telecommunications market, means the scope of business activities where buyers, sellers, and service providers directly or indirectly contact, negotiate, and trade goods and services; 3. Telecommunications market share, means the proportion of the value of goods and services traded by a particular enterprise in the telecommunications market; 4. Telecommunications trade secret, means information concerning telecommunications technology, production methods, business or services, which is of significant importance to the business and, if disclosed, would cause harm to the stability and financial condition of a telecommunications service provider; 5. Telecommunications service, means operating a telecommunications service business using telecommunications infrastructure and resources to obtain monetary returns or some benefit; 6. Telecommunications service provider, means a business unit operating a telecommunications business; 7. Telecommunications service user, means a person using the services provided by various telecommunications business units.
