Articles
Article 1
Regarding subjects eligible for the policy on restoration of pension: According to Decree No. 241/PM dated August 29, 2007, the subjects eligible for the policy on restoration of pension include:
1. State civil servants, military personnel, and police officers who participated in the revolution before December 2, 1975, who have left their positions, meet the conditions for receiving a pension, but only received a one-time allowance.
2. Persons appointed or assigned by Party and State organizational bodies to work in a state-owned enterprise, and who left their positions from 1994 onwards and thereafter.
3. State civil servants, military personnel, and police officers who left their positions by unauthorized departure (desertion) without approval from the relevant authority shall not be considered under any circumstances.
Article 2
Conditions for receiving restored pensions. 1. Persons eligible to receive restored pensions must meet the following conditions: — Women aged 50 years or older, men aged 55 years or older, calculated from the date of birth to the date of resignation and receipt of a lump-sum allowance; a work history of 20 years or more, calculated from the date of starting state employment to the date of resignation as a permanent staff member. — For those with a work history of 25 years or more but who are 1 to 3 years short of retirement age, if the person holds a disability certificate due to combat, combat service, or work involving exposure to toxic substances, or suffers from a chronic illness during their employment, the case shall be considered as a special circumstance. 2. Grade and salary grade comparison for those eligible for restored pensions: — Grade and salary grade comparison for staff of Party and state organizations and mass organizations shall follow Resolution No. 72/PCC of the Politburo of the Party Central Committee (December 13, 1993) and the Prime Minister's Decree on civil servant grades and ranks (No. 172/PM, August 11, 2005), applicable to those who were included in the state payroll before December 2, 1975. — Grade and salary grade comparison for those eligible for restored pensions in the armed forces: The grade and salary grade comparison for those eligible for restored pensions in the armed forces shall follow the Decree on Basic Salary Indices for the Armed Forces (No. 253/PM, August 12, 2005), and for those included in the state payroll before December 2, 1975, the following table applies:
