Article 1
Purpose. This Agreement on Labor Safety and Occupational Health at Construction Sites aims to establish principles and regulations to promote and achieve labor safety and occupational health standards at construction sites, formulate measures to prevent work-related accidents and occupational diseases, thereby protecting the lives and property of workers and employers operating at construction sites, and serve as a basis for organizing and handling incidents related to labor safety and occupational health in the construction sector.
Article 2
Definition of Terms. The terms used in this Agreement shall have the following meanings: 1. Construction refers to activities related to the construction, repair, restoration, reconstruction, extension, alteration, addition, or demolition of various types of structures, such as buildings, airports, railways, highways, tunnels, docks, bridges, hydroelectric dam, drainage ditches, water supply facilities, fences, walls, structures for installing billboards, and the relocation or demolition of various structures; 2. Construction site refers to the entire area where construction work is carried out; 3. Danger zone refers to the area where construction, scaffolding erection, use of lifting equipment, machinery, or electrical equipment for construction is in progress, the passage area for transporting construction materials, and the area where fuel, explosives, or construction materials are stored; 4. Electrical equipment refers to tools, appliances, or machinery that use electricity, as well as other materials related to electricity; 5. Pile driving refers to the method of driving piles into the foundation using a pile hammer or pressure as required; 6. Pile driver refers to machinery used for pile driving, consisting of a structural body and a power propulsion device, which may be separable or combined as a single unit; 7. Floating raft refers to boats, rafts, and other similar appliances used for construction operations on water; 8. Diaphragm wall (foundation wall) refers to a retaining wall or partition wall made of concrete or reinforced concrete as an underground structure, constructed by first excavating or drilling out soil, and then pouring concrete into the excavated or drilled trench; 9. Support (shoring) refers to temporary supports used to bear or strengthen the load of a structure, scaffolding, or concrete formwork during the construction period; 10. Machinery refers to a device composed of multiple components used to generate power, including related equipment or mechanical tools; 11. "Crane" refers to machinery used for lifting and lowering objects vertically and moving them horizontally by suspension, including winch-type machinery used for lifting objects vertically; 12. "Temporary material transport hoist" refers to an appliance used for transporting materials up and down to facilitate construction, consisting of a hoistway or shaft, a car, and machinery; 13. "Temporary personnel hoist" refers to an appliance used for transporting personnel up and down to facilitate construction, consisting of a hoistway or shaft, a car, and machinery; 14. "Scaffolding or work platform" refers to a working platform set up above the ground, floor level of a building, or construction area, used to temporarily support construction workers or materials; 15. "Tunnel" refers to an underground passage, a passage or cavity in a mountain; 16. "Marine construction operations" refers to various construction operations in water or on structures in water, including construction operations using floating rafts; 17. "Engineer" refers to a person who has obtained a practice license in accordance with the laws and regulations on engineers and engages in a professional occupation; 18. "Foreman (supervisor)" refers to a person responsible for facilitating or controlling and supervising construction operations, depending on the nature and category of the work.
