Articles

Article 1

Purpose. This decision is formulated to prescribe principles, regulations, and measures concerning the issuance and management of licenses for the sale, purchase, export, import, and transport of minerals and mineral products, as well as the collection of mineral resource taxes and fees within the territory of the Lao People’s Democratic Republic and cross-border mineral trade, in order to ensure strict and effective management of mineral trade.

Article 2

Definitions. "Minerals" in this Decision refer to ores that have been processed and upgraded in quality to become semi-finished or finished products. "Semi-finished mineral products" refer to minerals that have undergone primary or secondary processing and quality upgrading. "Finished mineral products" refer to the final products of the mining industry. "Sale of minerals under concession contracts" refers to the sale of minerals by legal entities that have obtained mining permits from the government in accordance with Articles 25 and 26 of the Mineral Law No. 02/ສພຊ, dated December 20, 2011. "Business of buying and selling minerals and mineral products" refers to the operational activities of domestic or foreign individuals or legal entities, licensed under this Decision, engaging in the purchase and sale of minerals in accordance with Article 25 of the Mineral Law No. 02/ສພຊ, dated December 20, 2011. "Introduction of minerals for domestic processing" refers to the import activity by domestic or foreign individuals or legal entities, licensed under this Decision, of importing minerals from abroad for self-processing domestically, or entrusting them to licensed domestic mineral processors for processing into semi-finished or finished mineral products, for domestic sale or export.

Article 3

Scope of Application. This decision applies to domestic and foreign individuals and legal entities engaged in mineral extraction, transportation, and mineral product processing under concession contracts, as well as domestic and foreign individuals and legal entities involved in the purchase and sale of minerals and mineral products, and the import and export of minerals and mineral products.
