Articles
Article 1
The Supplementary Order No. 09/PM, dated May 2, 2008 (regarding the handling of confiscated timber, collected timber, and stranded young timber) and the Agreement No. 23/PM, dated February 24, 2009 (regarding the permission for provinces and Vientiane Capital to export finished timber and managed timber of Categories 1, 2, and 3 from the effective date of Agreement No. 32/PM) are hereby repealed.
Article 2
Article 2: In accordance with Article 8 of the Government Law No. 02/NA dated May 8, 2003; and in accordance with Clause 10.1 of the Prime Minister's Agreement No. 3/PM dated March 6, 2012, approving the minutes of the meeting on forest management, forest inspection, and timber business held on January 25-26, 2012. Whereas, during the implementation of the aforementioned agreement, some sectors and localities had misinterpreted the content of Clause 10.1, believing that Order No. 17/PM dated September 22, 2008 must first be amended before repealing the Supplementary Order No. 09/PM dated May 2, 2008 and Agreement No. 23/PM dated February 24, 2009, while some units continued to apply and implement Supplementary Order No. 09/PM and Agreement No. 23/PM, such understanding and implementation being erroneous. In order to enable all central ministries, government-related agencies, and local authorities at all levels to uniformly and effectively implement Clause 10.1 of the Prime Minister's Agreement No. 32/PM dated March 8, 2012, approving the minutes of the meeting on forest management, forest inspection, and timber business held on January 25, 2012, the Prime Minister hereby issues the following order:
1. Repeal the Supplementary Order No. 09/PM dated May 2, 2008 on resolving issues of seized timber, collected timber, and retained softwood, and Agreement No. 23/PM dated February 24, 2009 on permitting provinces and Vientiane Capital to export sawn timber and timber of controlled categories 1, 2, and 3, effective from the date of entry into force of Agreement No. 3/PM (i.e., March 6, 2012). The above two regulations have been repealed by Agreement No. 32/PM.
2. Assign the Ministry of Agriculture and Forestry to take the lead, in coordination with the Ministry of Industry and Commerce, the Ministry of Natural Resources and Environment, and relevant parties, to urgently study and revise the incomplete aspects of Order No. 17/PM dated September 22, 2008, to align it with relevant laws, regulations, and actual conditions, and to promulgate and implement it as soon as possible.
3. Request Deputy Prime Ministers, heads of government agencies, the Mayor of Vientiane Capital, and Governors of all provinces to strictly and with high responsibility organize the implementation of this order in accordance with their respective duties, authorities, and jurisdictions.
4. This order shall take effect from the date of its signing.
