Directive
Directive of the Minister of Industry and Commerce on Enterprise Registration under the Enterprise Law
To:
- Provincial and Vientiane Capital Industry and Commerce Departments;
- District Industry and Commerce Offices;
- Business entities and individuals intending to establish enterprises in the Lao People’s Democratic Republic.
Subject: Implementation of enterprise registration under the Enterprise Law through the “One-Stop Service” system.
- Pursuant to the Enterprise Law No. 11/NA dated November 9, 2005;
- Pursuant to the Decree on the Organization and Operation of the Ministry of Industry and Commerce No. 188/PM dated August 17, 2006.
To implement the Enterprise Law and regulations related to enterprise registration, making enterprise registration services a “One-Stop Service” system that is convenient, fast, transparent, and easy to understand, facilitating the establishment of enterprises and changes in enterprise registration; enabling business entities that have registered under the Enterprise Law to fully conduct their business activities, and ensuring the implementation of regulations to promote, monitor, develop, and encourage business entities to expand, thereby laying the foundation for sustainable national economic development.
The Minister of Industry and Commerce hereby issues the following directive:
Article 2
Implementation of Enterprise Registration through the "One-Stop Service" System
In implementing and expanding the spirit of the Order No. 37/ນຍ dated October 24, 2006, on the Implementation of the Enterprise Law, and the Agreement No. 86/ນຍ dated August 3, 2007, on the Implementation of the "One-Stop Service" Mechanism in State Administrative Agencies, the Industry and Commerce sector has, during the pilot phase, established the "Enterprise Registration Authority" (abbreviated as "ຫຈທ") nationwide, formulated forms for various types and forms of enterprises, and prescribed the procedures, timeframes, and fees for enterprise registration, aiming to align the implementation of enterprise registration with the Enterprise Law, achieve uniformity nationwide, establish a National Database of business units, and enable network connectivity with relevant departments.
Article 3
Organizational Structure for Managing Enterprise Registration through "One-Stop Service"
The Ministry of Industry and Commerce has established organizations to manage enterprise registration through the "One-Stop Service" system at all levels, from central to local, systematically, including:
- Central Level: The Central Enterprise Registration Authority "ຫຈທ", located at the Ministry of Industry and Commerce (Department of Domestic Trade).
- Local Level: The Provincial Enterprise Registration Authority "ຫຈທ", located at the Provincial Departments of Industry and Commerce in all provinces nationwide.
As for the district or municipal level, the provincial "ຫຈທ" shall send responsible personnel to be stationed according to actual conditions.
