Articles
Article 1
Purpose. This Decree stipulates the principles, regulations, and procedures for the issuance of import licenses for goods, aiming to achieve uniformity, simplicity, and transparency, and to be consistent with international treaties to which the Lao People's Democratic Republic is a party, with the objective of facilitating the cross-border circulation of goods, contributing to the national economic development, and reducing poverty among the people in accordance with the goals set by the government.
Article 2
Interpretation of Terms. The terms used in this Decree shall have the following meanings:
1. Issuance of Import License: means the administrative procedure requiring an applicant for an import license to submit an application and related documents to the import license issuing authority before bringing goods into the customs territory of the Lao People’s Democratic Republic;
2. Goods Subject to Import License Application: means goods for which the applicant must submit an application to the import license issuing authority to obtain an import license before importing the goods, as specified in a separate notification on the list of goods requiring an import license issued by the Ministry of Industry and Commerce in coordination with relevant sectors;
3. Import License Issuing Authority: means a state administrative authority with the power to issue import licenses for goods in accordance with laws and regulations;
4. Import License Applicant: means an individual, organization, or legal entity with the right to import goods in accordance with the laws and regulations of the Lao People’s Democratic Republic;
5. Automatic Issuance of Import License: means the issuance of an import license immediately, and no later than within ten working days, to an applicant who has submitted complete and correct documents;
6. Non-automatic Issuance of Import License: means the issuance of a license not falling under paragraph 5 of this Article. Generally, non-automatic issuance of import licenses is used for the purpose of restricting the quantity (quota) of imported goods.
Article 3
Scope of Application. This Law applies to goods requiring import licenses, and any individual, organization, or legal entity has the right to import such goods.
The import of goods controlled by sanitary and phytosanitary measures and technical measures constituting trade barriers is not within the scope of this Law, and detailed provisions shall be separately formulated.
